A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The department of health, department of human services, and department of education shall research what rules, policies, and plan amendments are necessary to ensure that medically necessary services, including applied behavior analysis services, for individuals twenty-six years of age or younger with neurodevelopmental disorders, including autism spectrum disorder and fetal alcohol spectrum disorders, are covered under the following:

     (1)  The early and periodic screening, diagnostic, and treatment benefit under the State's medicaid program;

     (2)  Any applicable state special education services and programs; and

     (3)  The medicaid section 1915(c) home and community based waiver for individuals with intellectual and developmental disabilities.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 for the department of health, department of human services, and department of education to carry out the research of rules, policies, and plan amendments as required under section 1 of this Act.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 3000.
