A BILL FOR AN ACT

 

 

relating to the office of information practices.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 92F-41, Hawaii Revised Statutes, is amended to read as follows:

     "§92F-41  Office of information practices; established.  (a)  There is established an office of information practices within the department of accounting and general services for administrative purposes; provided that:

     (1)  Any quasi-judicial functions of the office of information practices shall not be subject to the approval, review, or control of the comptroller; and

     (2)  The comptroller shall not have the power to supervise or control the office of information practices in the exercise of its functions, duties, and powers under section 92F-42.

     (b)  The governor shall appoint a director of the office of information practices to be its chief executive officer and who shall be exempt from chapter 76.

     (c)  The director shall serve a term of six years that shall begin on January 1, 2024, and may be reappointed by the governor; provided that the governor may remove the director for cause.

     (d)  Whenever the position of director becomes vacant or prior to the appointment of the director for the term that begins on January 1, 2024, there shall be established a temporary selection committee consisting of three members appointed by the governor; provided that at least one member shall reflect the interests of citizens and the general public.  The committee shall:

     (1)  Review applications submitted and conduct interviews;

     (2)  Provide the public with an opportunity to consider, comment, and forward recommendations; and

     (3)  Submit the name of one candidate recommendation to the governor; provided that if the nominee is not accepted, the committee shall conduct a second round of the selection process.

     (e)  The governor shall consider the qualified individual submitted by the selection committee and accept or reject the selection within thirty days of submission.

     [(c)] (f)  All powers and duties of the office of information practices are vested in the director and may be delegated to any other officer or employee of the office.

     [(d)] (g)  The director may employ any other personnel that are necessary, including attorneys and clerical staff.  The office of information practices shall follow and be subject to all applicable personnel laws.  All personnel of the office of information practices shall be employed without regard to chapter 76.

     [(e)] (h)  The office of information practices shall make direct communications with the governor and legislature."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
