A BILL FOR AN ACT
RELATING TO OHANA ZONES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. There is established one full-time equivalent (1.0 FTE) position, to be appropriately titled, within the office of the governor, that shall be responsible for the deployment of the capital improvement funds appropriated by section 3 of this Act; provided that the governor may transfer the position to a designated executive branch department or agency.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the ohana zones pilot program established pursuant to Act 209, Session Laws of Hawaii 2018, as amended by Act 128, Session Laws of Hawaii 2019, as amended by Act 235, Session Laws of Hawaii 2022, including expenses relating to operations, upkeep of facilities, provision of services, and administrative costs.
The sums appropriated shall be expended by the office of the governor for the purposes of this Act; provided that the governor shall transfer the expenditure authority to designated executive branch departments or agencies within a reasonable time.
The appropriations made by this Act shall not lapse at the end of the fiscal years for which the appropriations are made; provided that all moneys from the appropriations that are unencumbered as of June 30, 2026, shall lapse as of that date.
Notwithstanding any other law to the contrary, the governor may transfer all or a portion of the appropriation in this section to the governor's designated executive branch departments or agencies for expenditures incurred in implementing the ohana zones pilot program.
The governor's designated executive branch departments or agencies may expend any appropriation transferred pursuant to this section for the performance of their respective duties under the ohana zones pilot program.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 to construct facilities for the ohana zones pilot program established pursuant to Act 209, Session Laws of Hawaii 2018, as amended by Act 128, Session Laws of Hawaii 2019, as amended by Act 235, Session Laws of Hawaii 2022; provided that:
(1) The appropriation made for the capital improvement project authorized by this section shall not lapse at the end of the fiscal biennium for which the appropriation is made; and
(2) All moneys from the appropriation unencumbered as of June 30, 2026, shall lapse as of that date.
The sums appropriated shall be expended by the office of the governor for the purposes of this Act; provided that the governor shall transfer the expenditure authority to designated executive branch departments or agencies within a reasonable time.

SECTION 4. Act 209, Session Laws of Hawaii 2018, as amended by Act 128, Session Laws of Hawaii 2019, as amended by Act 235, Session Laws of Hawaii 2022, is amended by adding a new section to read as follows:
"SECTION
4A. The ohana zones pilot program shall
be a government assistance program under section 201H-36(a)(2), Hawaii Revised
Statutes; provided that a regulatory agreement for a minimum term of ten years
shall be required under section 201H-36(b), Hawaii Revised Statutes, for
facilities constructed pursuant to section 3 of Act , Session
Laws of Hawaii 2023."
SECTION 5. The exemptions enumerated in section 3 of Act 235, Session Laws of Hawaii 2022, shall apply to ohana zone construction pursuant to this Act.
SECTION 6. This Act shall take effect on June 30, 3000.
