A BILL FOR AN ACT

 

 

RELATING TO TRANSIT-ORIENTED DEVELOPMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the promotion of mixed-use development and affordable housing within transit‑oriented development areas in the State is one of the most viable means for stimulating economic development opportunities and addressing the need for affordable housing.  The Hawaii interagency council for transit-oriented development, co-chaired by the director of the office of planning and sustainable development and executive director of the Hawaii housing finance and development corporation, has been instrumental in coordinating the preparation and subsequent implementation of the state strategic plan for transit-oriented development.  The state strategic plan serves as a guide to the statewide planning and coordination of state and county transit‑oriented development efforts.

     Since 2016, following the establishment of the Hawaii interagency council for transit-oriented development, the legislature has appropriated capital improvement project funds to the office of planning and sustainable development to support planning of transit-oriented development projects on Oahu and the neighbor island counties.  To date, thirteen state and county agencies have received funds from these appropriations, which have been and are being used to catalyze planning of twenty projects in the state strategic plan that will advance mixed-use and affordable housing developments statewide.  The legislature further finds that each year, the request for funds for this purpose has exceeded the funds available.

     The purpose of this Act is to appropriate general funds to the Hawaii community development authority for the planning, designing, and constructing of transit-oriented development projects.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the planning, designing, and constructing of the following projects:

     (1)  East Kapolei infrastructure implementation master plan;

     (2)  Villages of Kapolei road rehabilitation for county dedication;

     (3)  University of Hawaii, West Oahu on-site infrastructure for twenty-acre parcel;

     (4)  Kahului civic center;

     (5)  Kapaa: Samuel Mahelona memorial hospital master plan for on- and off-site infrastructure;

     (6)  Kualakai parkway overpass construction;

     (7)  East Kapolei infrastructure construction: roads, sewer, drainage;

     (8)  Kakaako street upgrades;

     (9)  Kewalo basin deck and pier improvements;

    (10)  Kalaeloa electrical undergrounding;

    (11)  Saratoga avenue electrical upgrade;

    (12)  Iwilei-Kapalama infrastructure upgrade;

    (13)  Road B entry plaza construction;

    (14)  Stadium storm-water holding tanks;

    (15)  Waipahu civic center;

    (16)  Lihue old police station/state civic center;

    (17)  Lihue transit-oriented development infrastructure master plan and preliminary environmental impact study;

    (18)  Hanapepe infill redevelopment;

    (19)  Keaau public transit hub, Hawaii;

    (20)  Kailua-Kona civic center master plan;

    (21)  Kailua-Kona transit-oriented development infrastructure master plan and preliminary environmental impact study;

    (22)  South Maui transit-oriented development corridor plan; and

    (23)  Kaahumanu avenue infrastructure master plan and preliminary environmental impact study.

     The sums appropriated shall be expended by the Hawaii community development authority for the purposes of this Act.

     SECTION 3.  The Hawaii community development authority, with the approval of the governor, may delegate to other state departments or agencies the implementation of projects, including the transfer of funds to implement those projects, authorized pursuant to this Act when the Hawaii community development authority determines it advantageous to do so.

     SECTION 4.  The appropriation made for the projects authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2026, shall lapse as of that date.

     SECTION 5.  This Act shall take effect on June 30, 3000.
