A BILL FOR AN ACT

 

 

RELATING TO PAID LEAVE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that receiving preventative care, such as an annual physical examination, reduces the risk for disease, disability, and death.  The legislature further finds that preventative care services are available to public employees at no cost through health insurance options offered by the Hawaii employer-union health benefits trust fund.  The legislature further finds that despite having access to this no-cost benefit, a significant number of public employees do not schedule an annual physical examination with their primary care physician.

     The purpose of this Act is to provide an incentive to public employees to schedule and attend a physical examination annually.

     SECTION 2.  Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§78-     Paid leave; physical examination.  Employees shall be eligible for up to two hours of paid leave per calendar year during normal business hours to attend a scheduled physical examination for the employee with a licensed physician, as defined under section 453-2; provided that the time off shall not be credited against vacation or sick leave benefits, if any; provided further that the provision of paid leave shall not adversely interfere with the operations of the work unit, nor require the applicable agency to incur additional human resources or overtime costs.

     An employee shall not be eligible for paid leave under this section for more than one physical examination in a single calendar year.  Travel time shall be included as part of the two hours permitted for each physical examination."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2023.
