HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING that THE STATE AUDITOR CONDUCT A SUNRISE ANALYSIS OF funeral directors and cemetery salespersons.

 

 

 


     WHEREAS, although certain death care professions require licensure in the State, no licensure requirements exist for funeral directors and cemetery salespersons; and

 

     WHEREAS, due to its sensitive subject matter, greater regulatory oversight of the death care industry is necessary; and

 

     WHEREAS, H.B. No.    , introduced during the Regular Session of 2023, establishes a death care industry board and requires that funeral directors and cemetery salespersons be licensed by the board; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, states that "[n]ew regulatory measures being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing or other regulatory controls shall be referred to the auditor for analysis"; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2023, the Senate concurring, that the Auditor is requested to conduct a sunrise analysis of the licensing of funeral directors and cemetery salespersons as proposed under H.B. No.     , which was introduced during the Regular Session of 2023; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days before the convening of the Regular Session of 2024; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Auditor.
