A BILL FOR AN ACT

 

 

relating to addiction Recovery care.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of health for administrative purposes the addiction recovery care working group to assist the counties in becoming recovery‑ready by addressing and treating substance use disorder through the availability of countywide recovery programs involving addiction prevention, treatment, and long-term recovery, ranging from crisis prevention to career building.

     (b)  The working group shall include the following members:

     (1)  The director of health, or the director’s designee, who shall serve as chair;

     (2)  One representative of the behavioral health services administration of the department of health;

     (3)  One representative of the alcohol and drug abuse division of the department of health;

     (4)  Until December 31, 2023, one representative of the department of public safety;

     (5)  Beginning January 1, 2024, one representative of the department of corrections and rehabilitation;

     (6)  One representative of the department of law enforcement;

     (7)  One representative of the department of human services;

     (8)  One representative of the Big Island drug court program;

     (9)  One representative of the Kauai drug court program;

    (10)  One representative of the Maui drug court program;

    (11)  One representative of the Oahu drug court program;

    (12)  The mayor of each county, or the mayor's designee;

    (13)  The attorney general, or the attorney general's designee;

    (14)  The president of the senate, or the president's designee;  

    (15)  The speaker of the house of representatives, or the speaker's designee;

    (16)  One representative of the Hawaii interagency council on homelessness;

    (17)  One representative of the university of Hawaii John A. Burns school of medicine's department of psychiatry; provided that the representative shall be affiliated with the American Society of Addiction Medicine;

    (18)  One representative of Hawaii Pharmacists Association, who shall be invited to participate;

    (19)  One or more representatives of the Hawaii Substance Abuse Coalition, who shall be invited to participate;

    (20)  One representative of the faith community having experience in substance use disorder recovery efforts, who shall be invited to participate; and

    (21)  Others as recommended and invited by the working group.

     (c)  The working group shall:

     (1)  Identify and evaluate the following:

          (A)  Each county's sources of funding and the relevant financial metrics of each source;

          (B)  Barriers to addiction recovery care access; and

          (C)  Policies and practices that perpetuate or substantially contribute to the barriers identified pursuant to subparagraph (B); and

     (2)  Make recommendations regarding the following:

          (A)  The establishment of a recovery-ready county certification program to encourage each county to inventory the county's resources; identify and address any gaps in addiction recovery services; coordinate sources of funding; and establish and identify long-term recovery measures for persons experiencing substance abuse disorder and resultant consequences, including homelessness;

          (B)  Appropriate and meaningful requirements for each county to receive recovery-ready county certification;

          (C)  Practices to improve care coordination and increase access to care;

          (D)  Policies or legislation to improve access to addiction recovery care; and

          (E)  Roles and responsibilities of the applicable state, county, and community entities.

     (d)  Members of the working group shall serve without compensation but shall be reimbursed for reasonable expenses necessary for the performance of their duties, including travel expenses.  No member of the working group shall be subject to chapter 84, Hawaii Revised Statutes, solely because of the member's participation in the working group.

     (e)  Two or more members of the working group, but less than the number of members that would constitute a quorum for the working group, may discuss matters relating to official business of the working group as necessary for the members to faithfully perform the members' duties to the working group and the organizations that the members represent; provided that no commitment to vote shall be made or sought during these discussions.

     (f)  The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     (g)  The addiction recovery care working group shall be dissolved on June 30, 2025.

     SECTION 2.  This Act shall take effect upon its approval.
