A BILL FOR AN ACT

 

 

RELATING TO THE SUPPLEMENTAL nUTRITION aSSISTANCE pROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Electronic benefits transfer cards; requirements for department; requirements for use.  (a)  The department shall print the name of the beneficiary of supplemental nutrition and assistance program benefits, or the beneficiary's parent or guardian if the beneficiary is a minor or an incapacitated individual, on each electronic benefits transfer card.

     (b)  To the extent allowable by federal law, no vendor shall allow a person to use an electronic benefits transfer card unless the person provides a photo identification at the time of the transaction that displays a name that conforms with the name printed on the electronic benefits transfer card.

     (c)  The department shall adopt rules pursuant to chapter 91 to implement this section.

     (d)  As used in this section:

     "Photo identification" means an identification card or other document issued by a government agency for the purpose of identification that contains the person's name and a photograph of the person's face.

     "Vendor" means a person who furnishes goods, services, or anything else of value upon presentation of an electronic benefits transfer card."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Requires the Department of Human Services to include the name of the beneficiary of supplemental nutrition and assistance program (SNAP) benefits on each electronic benefits transfer card.  Requires a photo identification to be presented when an electronic benefits transfer card is used.
