A BILL FOR AN ACT

RELATING TO THE STATE FOUNDATION ON CULTURE AND THE ARTS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to:

(1) Specify the qualifications for members of the state foundation on culture and the arts commission; and

(2) Appropriate funds to the state foundation on culture and the arts artist fellowship program for the awarding of one-time fellowships to promising artists in the amount of no less than $25,000 per fellowship.

SECTION 2. Section 9-2, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"(b) The foundation shall be governed by a policymaking and oversight commission to be known as the state foundation on culture and the arts commission. The commission shall be composed of nine members to be appointed and removed by the governor pursuant to section 26-34. The members of the commission shall:

(1) By reason of education or extensive experience, be generally recognized as having demonstrated accomplishment or expertise in the fields of culture, the arts, history, and the humanities;

(2) Be familiar with the people and cultures of Hawaii; and

(3) Include at least one member with a background or experience in each of the following:

(A) The needs of public education;

(B) Neighbor island communities;

(C) Native Hawaiian culture and diversity; and

(D) Urban design and public infrastructure.

The term of each member shall be for four years, commencing on July 1 and expiring on June 30; provided that for terms commencing on or after July 1, 1999, the governor shall appoint at least one member who resides in the county of Hawaii, one member who resides in the county of Kauai, and one member who resides in the county of Maui.

The governor shall appoint the chairperson of the commission from among its members. The members of the commission shall serve without compensation, but shall be reimbursed for travel and other necessary expenses in the performance of their official duties."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the state foundation on culture and the arts artist fellowship program for the awarding of one-time fellowships to promising artists in the amount of no less than $25,000 per fellowship.

The sums appropriated shall be expended by the state foundation on culture and the arts for the purposes of this Act.

SECTION 4. This Act shall take effect on June 30, 3000.
