A BILL FOR AN ACT

 

 

relating to driver's licenses.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in accordance with Act 159, Session Laws of Hawaii 2022, an individual who is between seventy-two and seventy-nine years of age is required to renew their driver's license every four years.  However, an individual who is eighty years of age or older is required to renew their driver's license every two years.  The legislature believes that these restrictions are unfairly restrictive for individuals who are eighty years of age or older.

     The legislature notes that many states have eliminated similar age-based restrictions on driver's license renewals.  The legislature also recognizes that during the regular session of 2022, the mayor of the city and county of Honolulu requested that the legislature introduce a measure to change from two to four years the period for renewal of driver's licenses for individuals who are seventy-two years of age or older, without any additional restrictions on those individuals who are eighty years of age or older.  The legislature further believes that allowing individuals who are eighty years of age or older to renew their respective driver's licenses every four years will help to relieve any additional burdens imposed on each county's respective driver licensing agency by Act 159, Session Laws of Hawaii 2022, including the time and resources required to process additional driver's license renewal applications.

     Accordingly, the purpose of this Act is to provide for the expiration, and require the renewal, of driver's licenses every four years for all individuals who are seventy-two years of age or older at time of issuance, including those individuals who are eighty years of age or older.

     SECTION 2.  Section 286-106, Hawaii Revised Statutes, is amended to read as follows:

     "§286-106  Expiration of licenses.  Every driver's license issued under this part, except for a provisional license issued under section 286-102.6 that shall expire on the date of the provisional licensee's nineteenth birthday, whether an original issuance or a renewal, shall expire on the first birthday of the licensee occurring no less than eight years after the date of the issuance of the license, unless sooner revoked or suspended; provided that:

     (1)  The license shall expire on the first birthday of the licensee occurring no less than four years after the date of the issuance if, at the time, the licensee is:

          (A)  Twenty-four years of age or younger; or

          (B)  Seventy-two years of age or older [but younger than eighty years of age;

     (2)  The license shall expire on the first birthday of the licensee occurring no less than two years after the date of the issuance of the license if, at that time, the licensee is eighty years of age or older]; and

    [(3)] (2)  If the licensee is a legal immigrant, the license shall expire no later than the licensee's authorized period of stay in the United States.

     The examiner of drivers may issue a license for a shorter period if the licensee has a physical condition or conditions that the examiner of drivers reasonably believes may impair the driver's ability to drive."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
