A BILL FOR AN ACT

 

 

RELATING TO CONDOMINIUM ASSOCIATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established a condominium voting and elections task force within the department of commerce and consumer affairs for administrative purposes that shall consist of the following members:

     (1)  A representative of the department of commerce and consumer affairs, to be designated by the director of commerce and consumer affairs;

     (2)  A member of the house of representatives, to be designated by the speaker of the house of representatives;

     (3)  A member of the senate, to be designated by the president of the senate; and

     (4)  Any additional member as deemed necessary by the task force.

     (b)  The task force shall:

     (1)  Investigate the feasibility of expanding the real estate commission's enforcement authority to include violations of requirements for association meetings and board of director elections;

     (2)  Investigate the feasibility of creating a condominium ombudsman's office under the department of commerce and consumer affairs, including proposed duties of the office and identifying feasible means of funding the office;

     (3)  Determine whether additional regulations are necessary for members of the board of directors to comply with their duties and obligations under chapter 514B, Hawaii Revised Statutes;

     (4)  Review the need for voting reform under chapter 514B, Hawaii Revised Statutes, including but not limited to proxy voting, board of director elections, notices of election, notice of intent to run for election, ballots, runoff elections, and forgery of ballot envelopes including penalties, if necessary; and

     (5)  Develop any necessary legislation to effectuate the purposes of this subsection.

     (c)  The members of the task force shall serve without compensation, but shall be reimbursed for reasonable expenses necessary for the performance of their duties, including travel expenses.

     (d)  The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2024.

     (e)  The task force shall cease on June 30, 2024.

     SECTION 2.  This Act shall take effect on June 30, 3000.
