A BILL FOR AN ACT

relating to professional license fee renewals.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§78- Professional licenses; renewal; fees. Notwithstanding any law to the contrary, each employer shall pay any fee required for the renewal of any professional license held by an employee of that employer; provided that the employer shall only be responsible for paying the renewal fee for a professional license that is necessary for the employee to carry out the employee's duties; provided further that nothing in this section shall be construed as requiring an employer to pay for an employee's initial professional license fee."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
