A BILL FOR AN ACT

 

 

RELATING TO FIREWORKS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 132D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§132D-     Fireworks-focused enforcement units.  (a)  Each county shall establish within its police department a fireworks‑focused enforcement unit that shall be dedicated exclusively to the enforcement of this chapter and any fireworks-related ordinance of the county; provided that the unit shall not be responsible for the issuance of permits or any duties of the county fire chief, fire department, county auditor, or auditor of fireworks and articles pyrotechnic records.

     (b)  Each unit shall prioritize its enforcement efforts toward times that are likely for heightened violations of this chapter or any fireworks-related ordinance of the county.

     (c)  No later than twenty days prior to the convening of each regular session, the mayor of each county shall submit to the legislature a report regarding the county's fireworks‑focused enforcement unit.  The report, at minimum, shall include:

     (1)  Information on the effectiveness of the unit;

     (2)  The budgetary needs of the unit; and

     (3)  Recommendations for proposed legislation."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for wages, salaries, and operating expenses for a fireworks-focused enforcement unit of the Honolulu police department.

     The sums appropriated shall be expended by the city and county of Honolulu for the purposes of this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for wages, salaries, and operating expenses for a fireworks-focused enforcement unit of the Hawaii police department.

     The sums appropriated shall be expended by the county of Hawaii for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for wages, salaries, and operating expenses for a fireworks-focused enforcement unit of the Maui police department.

     The sums appropriated shall be expended by the county of Maui for the purposes of this Act.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for wages, salaries, and operating expenses for a fireworks-focused enforcement unit of the Kauai police department.

     The sums appropriated shall be expended by the county of Kauai for the purposes of this Act.

     SECTION 6.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2023.
