A BILL FOR AN ACT

 

 

relating to feral chickens.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 322, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   .  FERAL CHICKENS

     §322-A  Definitions.  As used in this part:

     "Department" means the department of health.

     "Feral chicken" means any live chicken that is not:

     (1)  In captivity; and

     (2)  Owned by any individual or entity.

     §322-B  Removal of feral chickens; powers; penalties.  (a)  The department and each county may:

     (1)  Use electronic devices to trap and remove feral chickens, including electronic sensors and other remote-monitoring technologies; and

     (2)  Employ a feral chicken removal coordinator to manage the trapping and removal of feral chickens in urban areas.

     (b)  Any person who interferes with the trapping or removal, or both, of feral chickens by the department or a county shall be fined $500.

     §322-C  Feral chicken complaint hotline.  The department shall establish and operate a feral chicken complaint hotline that members of the public may call to:

     (1)  Report nuisances and health hazards caused by the presence of feral chickens; and

     (2)  Request removal of feral chickens."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 to contract the services of a third party to trap and remove feral chickens throughout the State and receive feral chickens from the public.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect on July 1, 2023.
