Authorizes the department of land and natural resources to use in-lieu fee mitigation to restore, create, enhance, preserve, or any combination thereof aquatic habitats or resources as compensatory mitigation.  (SD1)

RELATING TO WILDLIFE.

Requires all habitat conservation plans to include an agreement for plan participants to enter into and maintain an annual service contract with a stand-by and response facility available to provide emergency medical and rehabilitation services to native wildlife affected by activities undertaken within the plan area.  Takes effect 7/30/2050.  (SD1)

RELATING TO HISTORIC PRESERVATION.

Defines "pre-contact historic property".  Clarifies that the historic preservation program includes providing consultation to counties and public and private agencies involved in historic preservation and the development, publication, and distribution of materials about protections for burials, historic sites, and archaeological resources.  Amends the composition and duties of the Hawaii historic places review board.  Increases civil and administrative fines for certain violations of historic and preservation requirements and makes violators liable for costs associated with mitigation or restoration measures.  Takes effect 7/30/2075.  (SD2)

RELATING TO SOIL CLASSIFICATIONS.

Requires the Office of Planning and Sustainable Development to conduct a study of the suitability of the State's current soil overall (master) productivity rating system classified by the Land Study Bureau's detailed land classification.  Requires a report to the Legislature.  Appropriates moneys.  Effective 7/1/2050.  (SD1)

RELATING TO HISTORIC PRESERVATION REVIEWS.

Transfers authority for certain reviews of projects in conjunction with section 6E-42, HRS, from the Department of Land and Natural Resources to the Counties.  Defines the role of third-party reviewers for DLNR.  Provides financial assistance to the counties to hire qualified staff to conduct the reviews.  Effective 7/1/2050.  (SD2)

RELATING TO HUNTING GUIDES.

Requires that hunting guides obtain written permission from private landowners or other appropriate person before taking their clients to hunt on those private lands.  Requires hunting guides to provide copies of those written permission documents to the Department of Land and Natural Resources.  Takes effect 7/1/2050.  (SD1)

RELATING TO THE PAYMENT OF DEBT SERVICE ON THE TURTLE BAY REIMBURSABLE GENERAL OBLIGATION BONDS.

Streamlines the process for completing the Department of Land and Natural Resources' required annual payment of debt service on the reimbursable general obligation bonds for Turtle Bay.  Effective 7/1/2050.  (SD2)

RELATING TO DAM AND RESERVOIR SAFETY.

Establishes the dam and spillway loan and grant programs for plans, design, construction, and equipment that is used to improve deficient dams and spillways as determined by the Department of Land and Natural Resources and approved by the Board of Land and Natural Resources.  Specifies eligibility requirements for dam and spillway improvement grants.  Establishes the dam and spillway improvement tax credit for expenditures for dam and spillway improvements that bring dams and spillways up to code.  Appropriates funds.  Takes effect 7/1/2050.  (SD1)

RELATING TO SHOOTING FACILITIES.

Establishes a working group consisting of the Chairperson of the Board of Land and Natural Resources, the Director of Public Safety, and hunters and recreational shooters to determine potential locations and requirements for a shooting facility in the County of Hawaii.  Appropriates funds to establish the shooting facility in the County of Hawaii.  Requires the County of Hawaii to match funds appropriated on a dollar-for-dollar basis.  Effective 7/1/2050.  (SD1)

RELATING TO COMMERCIAL ACTIVITIES ON BEACHES.

Prohibits any person from presetting commercial beach equipment on beaches encumbered with easements in favor of the public unless the customer is present.  Pertains only to public beaches and does not include private lands such as accreted lands.  Takes effect 7/1/2050.  (SD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
