RELATING TO HISTORIC PRESERVATION REVIEWS. Allows the Department of Hawaiian Home Lands to assume historic preservation review of the effect of any proposed project for lands under its jurisdiction except for projects affecting properties listed or nominated for inclusion in the Hawaii register of historic places or the national register of historic places.

RELATING TO TRANSFERABILITY OF MOORING PERMITS. Allows a holder of a mooring permit within a state small boat harbor to transfer the mooring permit under certain terms and conditions.

RELATING TO THE ALA WAI BOAT HARBOR. Authorizes BLNR to issue revenue bonds for the purpose of financing repairs of the Ala Wai boat harbor.

RELATING TO A STATE BOATING FACILITY LEASE PROGRAM. Establishes a state boating facility lease pilot program within the Department of Land and Natural Resources. Clarifies that a private partner under lease or contract with the Department may assist with development, management, and maintenance of a state small boat harbor.

RELATING TO DISPOSITION OF WATER LICENSES BY THE BOARD OF LAND AND NATURAL RESOURCES. Clarifies the conditions and manner in which the Board of Land and Natural Resources may dispose of water by license.

RELATING TO THE PAYMENT OF DEBT SERVICE ON THE TURTLE BAY REIMBURSABLE GENERAL OBLIGATION BONDS. Streamlines the process for completing the Department of Land and Natural Resources' required annual payment of debt service on the reimbursable general obligation bonds for Turtle Bay.

RELATING TO HISTORIC PRESERVATION REVIEWS. Transfers authority for certain reviews of projects in conjunction with section 6E-42, Hawaii Revised Statutes, from the Department of Land and Natural Resources to the Counties. Provides financial assistance to the Counties to hire qualified staff to conduct the reviews.

RELATING TO STORMWATER FEES. Exempts the State, and its departments and agencies, from county stormwater user fees. Prohibits a county from denying services to the State or its departments and agencies by reason of nonpayment of user fees.

RELATING TO THE DIVISION OF BOATING AND OCEAN RECREATION. Allows the board of land and natural resources to adopt, amend, or repeal administrative fee schedules for parking fees for locations under the management of or operated by the division of boating and ocean recreation through regular or special board meetings rather than through administrative rulemaking.

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES. Appropriates moneys to the Department of Land and Natural Resources for establishing 28.0 FTE positions in parks administration and operation (LNR 806) to implement visitor reservation systems in Hawaii state parks. Appropriates additional moneys to the Department of Land and Natural Resources from the state parks special fund for purposes of state park management.

RELATING TO DEVELOPMENT RIGHTS. Expands the authority of the counties to transfer development rights to address areas at risk of sea level rise, coastal erosion, storm surge, or flooding.

RELATING TO LAND STUDY BUREAU CLASSIFICATIONS AND RATINGS. Temporarily establishes the land study bureau classifications and ratings review subcommittee within the land use commission to review and amend land study bureau classifications and ratings of agricultural lands. Repeals on 12/31/ .

RELATING TO THE STADIUM DEVELOPMENT DISTRICT. Clarifies the composition of the stadium authority as added by Act 146, Session Laws of Hawaii 2021.

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Removes county councils as the nominating authority for members of the Hawaii Community Development Authority who serve as representatives of the Heeia, Kalaeloa, and Kakaako community development districts. Provides that the President of the Senate and the Speaker of the House of Representatives shall each nominate representatives of each of the three community development districts.

RELATING TO GOLF COURSES AND DRIVING RANGES. Makes owners and operators of golf courses and driving ranges strictly liable for property damage to surrounding residential properties caused by golf balls hit by patrons of the golf course or driving range unless the owners and operators can show they took reasonable steps to prevent golf balls from leaving the golf course or driving range.

RELATING TO STREAM MAINTENANCE. Requires the department of land and natural resources to establish and implement a two-year stream maintenance reimbursement pilot program to reimburse homeowners for clearing debris in and around streams near their property. Appropriates funds.

RELATING TO STATE PARKS. Requires the department of land and natural resources to conduct a feasibility study on a revenue generating and management system of user fees for Hawaii's state parks and to submit a report to the legislature.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
