RELATING TO NEGLIGENT HOMICIDE. Makes it a class A felony for a person to cause the death of another while operating a vehicle in a negligent manner and under the influence of an intoxicant if the person has one or more convictions for operating a vehicle under the influence of an intoxicant within twenty years of the instant offense, a suspended and revoked license and privilege to operate a vehicle due to driving while under the influence of an intoxicant, or the person is a highly intoxicated driver.

RELATING TO THE POWER OF ARREST. Updates the list of federal agencies whose law enforcement officers may make arrests for certain offenses under state law by adding United States Immigration and Customs Enforcement-Homeland Security Investigations and deleting United States Citizenship and Immigration Services from the list. Updates references to the titles of the heads of the district offices for the listed federal agencies and the names of these agencies, including United States Customs and Border Protection.

RELATING TO SPOUSAL SUPPORT. Allows obligees under a order solely for spousal support to elect to enforce the order pursuant to chapters 651, 652, and 653, Hawaii Revised Statutes, rather than through the clerk of the court. Effective 7/1/2060. (HD1)

RELATING TO INFORMATION PRIVACY AND SECURITY COUNCIL. Amends section 487N-5(a), Hawaii Revised Statutes, to allow for each member of the Information Privacy and Security Council to designate a designee to act on the member's behalf in order to ensure quorum.

RELATING TO FAIR HOUSING REASONABLE ACCOMMODATIONS. Defines "assistance animal" in the context of Hawaii law prohibiting discrimination in real property transactions. Codifies the administrative process in verifying that a person requesting a reasonable accommodation that includes the use of an assistance animal has a disability and the assistance animal is needed to alleviate one or more symptoms of the person's disability. Specifies that possession of a vest or other distinguishing animal garment, tag, or registration document commonly purchased online and purporting to identify an animal as a service animal or assistance animal does not constitute valid verification. Effective 11/1/2022. (HD1)

RELATING TO TRAFFIC VIOLATIONS. Requires the driver of a moped to be in immediate possession of a valid driver's license or instruction permit at all times. Effective 7/1/2050. (HD1)

RELATING TO HIGHWAYS. Allows the State and counties to apply flexibility in highway design. Clarifies that the State and counties shall not be held jointly and severally liable for acts or omissions relating to a condemned road that occurred prior to condemnation. Effective 7/30/2075. (HD1)

RELATING TO FISHING. Prohibits the possession or use of unmanned aerial vehicles in state marine waters for purposes of fishing. Effective 7/1/2050. (HD1)

RELATING TO COMMERCIAL ACTIVITIES ON BEACHES. Prohibits any person from presetting commercial beach equipment on any public beach under the jurisdiction of the department of land and natural resources, unless the customer is physically present. Requires commercial vendors to expeditiously remove commercial beach equipment after the customer has finished using it. Allows the department of land and natural resources to grant exemptions through rules adopted pursuant to chapter 91, Hawaii Revised Statutes. Establishes administrative fines for violations. Pertains only to public beaches and does not include private lands such as accreted lands. Takes effect 7/1/2050. (HD1)

RELATING TO THE COMMISSION ON WATER RESOURCE MANAGEMENT. Adds the chairperson of the Hawaiian Homes Commission or the chairperson's designee to serve as an ex officio, voting member on the Commission on Water Resource Management. Takes effect 7/1/2050. (SD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
