RELATING TO THE HAWAII CODE OF MILITARY JUSTICE.

Adopts a new Hawaii Code of Military Justice to promote order and discipline in the state military forces by fostering an independent military justice system and updating non-judicial punishment and courts-martial procedures.  Effective 7/30/2075.  (HD1)

RELATING TO THE TAXATION BOARD OF REVIEW.

Adjusts membership of the state taxation board of review to three paid, full-time members, and sets a two-member quorum.  Requires the chair of the board to have certain qualifications.  Authorizes board members to validate board actions by a majority of the members who heard the appeal.  Establishes a compensation schedule for board members.  Clarifies that board meetings are contested case hearings and provides notice requirements. Clarifies the legal and evidentiary framework the board may use in reaching its decisions.  Appropriates funds.  Effective 10/18/2050.  (HD1)

Housekeeping measure that repeals references in sections 11‑322(b) and 11‑323(b), HRS, to paragraphs in subsection (a) of those statutes that have been repealed.

Allows the comptroller to direct the transfer of records to the state records center and determine the time period at which the records should be transferred.  Appropriates funds to the office of enterprise technology services for operating costs and equipment for the state records center and for positions within the state archives.  Effective 7/1/2112.  (HD1)

RELATING TO ABANDONED WELLS.

Establishes an income tax credit for taxpayers who are required to seal abandoned wells on their real property.  Clarifies the definition of the term "abandoned well".  Requires an owner of an abandoned well to seal the well at the owner's expense.  Appropriates funds for three full-time equivalent (3.0 FTE) positions under the Commission on Water Resource Management.  Effective 7/1/2050.  (HD1)

RELATING TO THE WAHIAWA IRRIGATION SYSTEM.

Requires the Office of the Governor to negotiate the State's fee simple acquisition of the Wahiawa Irrigation System on the island of Oahu.  Authorizes and appropriates moneys for the Department of Agriculture, Agribusiness Development Corporation, and Department of Land and Natural Resources to purchase, repair, and maintain the Wahiawa Irrigation System and an associated spillway.  Effective 7/1/2050.  (SD2)

RELATING TO WILDLIFE.

Requires all habitat conservation plans to include an agreement for plan participants to enter into and maintain an annual service contract with a stand-by and response facility available to provide emergency medical and rehabilitation services to native wildlife affected by activities undertaken within the plan area.  Takes effect 7/30/2050.  (SD1)

RELATING TO HISTORIC PRESERVATION.

Defines "pre-contact historic property".  Clarifies that the historic preservation program includes providing consultation to counties and public and private agencies involved in historic preservation and the development, publication, and distribution of materials about protections for burials, historic sites, and archaeological resources.  Amends the composition and duties of the Hawaii historic places review board.  Increases civil and administrative fines for certain violations of historic and preservation requirements and makes violators liable for costs associated with mitigation or restoration measures.  Takes effect 7/30/2075.  (SD2)

RELATING TO SPECIAL PURPOSE REVENUE BONDS TO ASSIST THE HAWAIIAN LEGACY REFORESTATION INITIATIVE TO RESTORE HAWAII'S FORESTS AND NATURAL RESOURCES.

Authorizes the Department of Budget and Finance to issue special purpose revenue bonds to assist Hawaiian Legacy Reforestation Initiative, LLC in its mission to proliferate a sustainable model of endemic reforestation, ecosystem revitalization, endangered species recovery, and carbon credit sequestering.  Effective 7/1/2050.  (SD1)

RELATING TO THE BARBERING AND COSMETOLOGY LICENSING ACT.

Adds and updates definitions to satisfy current industry practice needs.  Aligns and remedies inconsistencies between chapters 438 and 439, Hawaii Revised Statutes.  Removes the five-year license requirement for barber and beauty operator board of barbering and cosmetology member seats.  Raises fees for penalties and disciplinary actions and removes medical clearance requirements.  Effective 1/1/2050.  (HD1)

RELATING TO COUNTIES.

Requires the counties to maintain infrastructure within sixty days and under specified conditions, as part of any housing development for the department of Hawaiian home lands.  Effective 7/1/2050.  (HD1)

RELATING TO THE PUBLIC HOUSING AUTHORITY.

Allows the Hawaii public housing authority to develop mixed-income and mixed-financed housing projects.  Prohibits the development or construction of housing projects on ceded land that is vacant on or after 1/1/2022.  Effective 7/1/2050.  (HD1)

RELATING TO INFRASTRUCTURE MAINTENANCE IN HOUSING SUBDIVISIONS.

Establishes a working group to examine and address the problem of infrastructure repair and maintenance in planned housing subdivisions that do not have compulsory homeowner associations.  Requires a report to the legislature prior to the 2024 regular session.  Appropriates funds subject to a county contribution of matching funds.  Effective 7/1/2050.  (HD1)

Status

RELATING TO PUBLIC LANDS.

Exempts lands set aside by the Governor to the Hawaii Housing and Finance Development Corporation from classification as public land subject to Department of Land and Natural Resources management; provided that the lands are not ceded lands.  Effective 7/1/2050.  (SD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
