MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF THE ATTORNEY GENERAL. Makes an emergency appropriation to the Department of the Attorney General for retention of expert witnesses and specialized legal counsel in major litigation against the State of Hawaii. Effective 7/1/2050. (SD1)

RELATING TO GAMBLING. Imposes a heightened penalty of a class C felony for persons who repeatedly commit the offenses of gambling, possession of gambling records in the second degree, or possession of a gambling device. Effective 7/30/2075. (SD2)

RELATING TO ABUSE OF FAMILY OR HOUSEHOLD MEMBERS. Adds abuse of family or household members to those felonies that qualify for repeat offender sentencing.

Updates the purpose of the children's justice program to include investigation and management of cases involving suspected or confirmed child sex trafficking, commercial sexual exploitation of children, other child maltreatment, and child witnesses to crime or violence. RELATING TO HAWAII CRIMINAL JUSTICE DATA CENTER FEES. Provides authority for the Hawaii criminal justice data center to set and collect fees for services provided. (SD1)

RELATING TO THE COMMISSION TO PROMOTE UNIFORM LEGISLATION. Provides a limited exemption for the Hawaii Commission to Promote Uniform Legislation from certain requirements of part I of chapter 92, HRS, for the purpose of allowing commissioners of the Commission to Promote Uniform Legislation to attend and participate in a full capacity in meetings hosted by the Uniform Law Commission, without any limitation on the number of participating commissioners, in furtherance of its goal of representing and promoting uniformity of legislation for the State.

RELATING TO CONSTITUTIONAL AMENDMENTS. Requires the language and meaning of any proposed constitutional amendment and ratification question to be simple, concise, and direct to the extent practicable. Allows the presiding officers of the Legislature to request a written opinion of the Supreme Court regarding the legality of a proposed amendment to the Hawaii State Constitution and the corresponding constitutional ratification question. Requires the supreme court to provide a written opinion within one week of receipt of the request. Requires, for any written opinion by the supreme court that invalidates a constitutional ratification question, a detailed and specific explanation of the reasons for this opinion. Prohibits any appeal of a written opinion. Takes effect 7/30/2075. (SD1)

RELATING TO ELECTRONIC EAVESDROPPING. Amends provisions relating to electronic eavesdropping. Requires law enforcement entities to obtain a search warrant before accessing a person's electronic communications in certain circumstances. Amends notification requirements of a law enforcement entity's access to electronic communications to allow for discovery in criminal cases.

RELATING TO IDENTIFICATION CARDS. Authorizes the issuance of limited purpose identification cards for certain residents. Takes effect 7/30/2075. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
