RELATING TO THE DISPOSITION OF WATER RIGHTS. Exempts the instream use of water for (1) traditional and customary kalo cultivation practices and (2) commercial kalo cultivation conducted in a manner consistent with traditional and customary Native Hawaiian practices from the existing process for disposition of water rights. Effective 7/1/2050. (HD2)

RELATING TO IMPORTANT AGRICULTURAL LANDS. Allows landowners and lessees of important agricultural lands to apply to the counties to develop, construct, and maintain farm cluster housing on the lands for rent to farmers and farm employees who actively and currently farm on the land but also exempts certain counties from this process. Removes restrictions on farm dwellings on important agricultural lands that are stricter than that for farm dwellings under the agricultural land use district. Effective 7/1/2050. (HD2)

RELATING TO THE COMPREHENSIVE OFFENDER REENTRY SYSTEM. Clarifies that the department of public safety's role is to work with the department of transportation and county examiners of drivers to assist inmates in procuring civil identification cards necessary to transition into the workforce, access social services, and secure housing, rather than issue civil identification cards. Effective 7/1/3000. (HD1)

RELATING TO THEFT. Amends the offense of theft in the first degree to specifically include theft of a motor vehicle, motorcycle, or moped as defined in section 291C-1, HRS. Effective 1/1/2050. (HD1)

RELATING TO CATALYTIC CONVERTERS. Requires licensed used motor vehicle part dealers to keep records of purchases and sales of catalytic converters and requires the sellers to file a written statement that the seller has the lawful right to sell and dispose of the catalytic converter. Establishes the felony offense of theft of catalytic converter. Increases the penalty for engaging in the business of purchasing or selling used motor vehicle parts and accessories without a license. Requires scrap dealers to keep records of purchases and sales of palladium, platinum, and rhodium. Requires all scrap dealers to pay for palladium, platinum, and rhodium, and used motor vehicle part dealers to pay for catalytic converters, by check. Effective 1/1/2050. (HD1)

RELATING TO THE COUNTIES. Authorizes counties, after adoption of an ordinance, to sell private property after all notices, orders, and appeal proceedings are exhausted and to use those revenues to pay unpaid civil fines related to that property. Effective 1/1/2050. (HD1)

RELATING TO SOLAR ENERGY. Authorizes the governing body of a county to create, by ordinance, a process for the recordation and enforcement of solar easements. Allows counties to require individuals claiming a solar right to record that right by filing a declaration with the county clerk. Authorizes the governing body of a county to require, by ordinance, the trimming of vegetation that blocks solar radiation from solar energy devices. Authorizes the ordinance to include a designation for the cost of trimming. Effective 7/1/2100. (HD1)

RELATING TO THE UNIFORM RECOGNITION AND ENFORCEMENT OF CANADIAN DOMESTIC-VIOLENCE PROTECTION ORDERS ACT. Enacts the Uniform Recognition and Enforcement of Canadian Domestic-Violence Protection Orders Act. Effective 7/1/2060. (HD1)

RELATING TO SEXUAL ABUSE OF MINORS. Expands the time period by which a civil action for childhood sexual abuse may be initiated, including an otherwise time‑barred action. Adopts certain procedural requirements prior to the filing of a civil action for childhood sexual abuse or naming of "Doe" defendants. Authorizes a court to require personnel of legal entities to undergo training on trauma‑informed response. Effective 7/1/2060. (HD1)

RELATING TO HOUSING. Conditions the authority of a county whose population is greater than five hundred thousand to exercise state housing powers upon a county's continued compliance with provisions regarding the acceptance of the dedication of infrastructure and public highways in affordable housing developments. Amends various provisions relating to the dedication of infrastructure to a county. Effective 7/1/2050. (HD1)

RELATING TO EMPLOYMENT PRACTICES. Prohibits an employer from entering into or requiring an employee to enter into a nondisclosure agreement pertaining to sexual harassment or sexual assault occurring in the workplace, at work-related events, between employees, or between the employer and an employee. Effective 12/25/2040. (HD1)

RELATING TO PUBLIC WORKS. Imposes penalty on both the person and firm upon finding of certain violations of state law governing wages and hours of employees on public works. Defines "person" and "firm" for these purposes. Effective 12/25/2040. (HD1)

RELATING TO EMERGENCY MANAGEMENT. Clarifies that the powers granted for emergency purposes shall not be inconsistent with the state constitution. Provides parameters for the duration of suspension of laws and requires justification for the suspension. Authorizes the governor to require counties to obtain approval prior to issuing any emergency order, rule, or proclamation. Clarifies that a state of emergency may be extended or terminated by a separate or supplementary proclamation. Authorizes the legislature to terminate a state of emergency, in part or in whole, by an affirmative two-thirds vote. Specifies that prohibitions on price increases of essential commodities during a severe weather warning expire seventy-two hours after the effective date and time of the initial declaration or any supplemental proclamation. Effective 7/1/2050. (HD1)

RELATING TO HABITAT CONSERVATION PLANS. Requires any person, before engaging in an activity with a high likelihood of resulting in an incidental take of a threatened or endangered species, to enter into a planning process with DLNR for the purpose of preparing and implementing a habitat conservation plan. Requires habitat conservation plans to include additional components. Effective 7/1/2050. (HD1)

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Amends the membership of the Hawaii Community Development Authority by removing the county council as the nominating authority for the community development district representatives, removing one at-large member, reducing the number of district resident representatives, and making the director of planning and permitting of each county a voting, rather than a nonvoting, member. Effective 7/1/2050. (HD1)

RELATING TO HISTORIC PRESERVATION REVIEWS. Allows the department of Hawaiian home lands to assume historic preservation review of the effect of any proposed project for lands under its jurisdiction under certain conditions and except for projects affecting properties listed or nominated for inclusion in the Hawaii register of historic places or the national register of historic places or located in a designated historic district. Effective 7/1/2050. (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
