RELATING TO CRIMINAL PROCEDURE.

Specifies under the Hawaii Rules of Evidence that a court may order that the testimony of witnesses be taken through a live two-way video connection in certain circumstances.

RELATING TO COVID-19 VACCINATION STATUS.

Makes it a civil violation for a person to:  (1) misrepresent to a business, church, nonprofit organization, or governmental entity the person's COVID-19 vaccination status, including the person's medical condition or religious beliefs as the basis for a COVID‑19 vaccine exemption; (2) falsify or alter a COVID-19 vaccination card, or purchase a falsified or altered COVID-19 vaccination card, for personal use; (3) use a falsified or altered COVID-19 vaccination card; or (4) sell, distribute, or manufacture, regardless of whether the person is compensated, a falsified or altered COVID-19 vaccination card for use by others.  Establishes fines.  Effective 7/1/2050.  Repeals on 6/30/2023.  (HD1)

RELATING TO THE UNIVERSITY OF HAWAII BOARD OF REGENTS.

Changes the number of terms of University of Hawaii Board of Regent members that should expire each year from three to two.  Adjusts the terms of members appointed between 2022-2026 to realign the number of terms scheduled to expire each year.  Effective 7/1/2050.  (HD1)

RELATING TO CIVIL RIGHTS.

Specifies additional forms of discrimination and other prohibited conduct under Chapter 368D, HRS.  Requires entities with state education programs or activities, or that receive state funding for educational programs or activities, to adopt written policies and undertake other specified enforcement actions no later than 1/1/2023.  Requires annual reports to legislature.  Appropriates funds.  Effective 7/1/2050.  (HD1)

RELATING TO COLLECTIVE BARGAINING.

Establishes that the representative of labor on the Hawaii Labor Relations Board shall be a person selected by a majority of the exclusive representatives of the collective bargaining units.  Provides a timeframe for the governor to appoint the representative of labor following submission of the nominee's name.  Effective 12/25/2040.  (HD1)

RELATING TO LIFEGUARDS.

Provides that any person qualified as a county lifeguard who renders rescue, resuscitative, or other lifeguard services, without remuneration or expectation of remuneration, on a beach or in the ocean in the scope of the person's employment as a county lifeguard, shall not be liable, and the employing county shall not be liable, for any civil damages resulting from the person's act or omissions while providing rescue, resuscitative, or other lifeguard services, except as may result from the person's gross negligence or wanton acts or omissions.

RELATING TO SPECIAL MANAGEMENT AREAS.

Expands exclusions from the definition of "development" as it applies to special management areas to reduce the need for special management area permits for certain activities.  Effective 7/1/2050.  (HD1)

RELATING TO LAND USE DISTRICT BOUNDARIES.

Establishes a boundary review committee to render decisions on district boundary disputes brought before the land use commission.  Effective 7/1/2050.  (HD1)

RELATING TO REAL PROPERTY.

Requires an applicant seeking to register more than ten acres of land with either the land court or the bureau of conveyances to provide a sworn affidavit that the community where the land is located has been given notice of the applicant's intended use of the land and a copy of the notice.  Effective 7/1/2050.  (HD1)

RELATING TO ABANDONED VEHICLES.

Makes a person who is the registered owner of a vehicle that was deemed abandoned or derelict subject to a tiered fine system.  Effective 7/1/2050.  (HD1)

Status

RELATING TO TOBACCO MANUFACTURER QUALIFIED ESCROW FUNDS.

Provides a mechanism to assign non-participating tobacco manufacturers' qualified escrow account balances to the State of Hawaii.  Also provides a mechanism for the financial institution acting as the escrow agent of the qualified escrow account to petition the courts to authorize transfer of funds to the State when the qualified escrow account is abandoned.

Status

RELATING TO GAMBLING.

Amends the offense of promoting gambling in the second degree to a class C felony without the possibility of probation or suspension of sentence.  Amends the offense of promoting gambling in the first degree to a class B felony without the possibility of probation or suspension of sentence.  Amends the requisite state of mind to criminal negligence for both offenses.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
