RELATING TO CAMPAIGN FINANCE. Requires the maintenance of transfer records relating to certain campaign contributions and transfers. Requires certain covered persons to seek permission from contributors to use of transfer contributed funds for independent campaign spending. Requires certain major contributors to disclose and maintain relevant records relating to the identities of other contributors. Requires certain covered persons to file disclosure reports with the Campaign Spending Commission. Facilitates the identification of certain top contributors of funds for certain political advertisements. Prohibits structured transactions. Takes effect 7/30/2075. (SD1)

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW. Increases from $1,000 to $5,000 the fine that may be assessed for campaign spending law violations against a noncandidate committee making only independent expenditures and that has received at least one contribution of more than $10,000, or spent more than $10,000 in an election period. Allows the Campaign Spending Commission to order that the fine be up to three times the amount of the unlawful contribution or expenditure, and that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

RELATING TO CANDIDATE COMMITTEE AND NONCANDIDATE COMMITTEE ORGANIZATIONAL REPORTS. Housekeeping measure that repeals references in sections 11‑322(b) and 11‑323(b), HRS, to paragraphs in subsection (a) of those statutes that have been repealed.

PROPOSING AMENDMENTS TO ARTICLE IV, SECTIONS 4 AND 6, OF THE HAWAII STATE CONSTITUTION REGARDING REAPPORTIONMENT. Proposes a constitutional amendment to specify that reapportionment shall be based upon the resident population, as counted in the most recent decennial United States Census. (SD1)

RELATING TO ELECTIONS. Requires the Chief Election Officer, with assistance from the county clerks for elections that involve county offices and countywide ballot issues, to publish and distribute a voters' pamphlet. Effective 7/30/2075. (SD2)

RELATING TO ELECTIONS. Requires the Office of Elections to prepare a digital voter registration guide to be posted on its website. PROPOSING AN AMENDMENT TO THE HAWAII CONSTITUTION REGARDING THE FREEDOM OF SPEECH. Proposes a symbolic constitutional amendment to provide that freedom of speech protected under the Hawaii State Constitution does not include the expenditure of money to influence elections. (SD1)

RELATING TO STATE EMPLOYEES. Subjects interns who work for the State to the provisions of chapter 84, Hawaii Revised Statutes, otherwise known as the State Ethics Code, by defining and including the term "intern" in the definition of employees, who are subject to the provisions of the Code. (SD1)

RELATING TO PUBLIC PARTICIPATION IN GOVERNMENT. Repeals chapter 634F, Hawaii Revised Statutes. Enacts the Uniform Public Expression Protection Act. (SD1)

RELATING TO THE BOARD OF EDUCATION. Requires the Board to include an open forum for public comments on non-agenda items at the end of board meetings. Requires the Board of Education to hold not less than six community forums annually, with at least one forum in each county. Requires a report to the Legislature on implementing open forums. RELATING TO PUBLIC RECORDS. Imposes a cap on the costs charged for the reproduction of certain government records. Waives reproduction costs for the first 100 pages if disclosure is in the public interest. Waives the cost of duplication of government records in an electronic format. Imposes a cap on costs charged for searching for, reviewing, and segregating records. Provides for a waiver of fees when the public interest is served by a record's disclosure. Effective 7/1/2050. RELATING TO GOVERNMENT RECORDS. Allows the Comptroller to direct the transfer of records to the State Records Center and determine the time period after which the records shall be transferred as directed. Appropriates moneys from the general fund, special fund, and American Rescue Plan funds for the statewide digitization of government records through the Office of Enterprise Technology Services. RELATING TO PROCUREMENT. Establishes a procurement services consolidation working group, which shall develop a plan for the phased consolidation, under the State Procurement Office, of all state executive branch procurement services and staff within 5 years, except those of the Department of Education, Hawaii Health Systems Corporation, University of Hawaii, and Office of Hawaiian Affairs. Requires the working group to recommend ways to attract high-quality procurement professionals to the State. Appropriates moneys. Effective 7/1/2050. (SD2)

Authorizes, where it is determined that a solicitation or award of a contract is in violation of law, government contract to be rescinded and awarded to the next lowest responsive, responsible bidder to whom the contract would have been awarded were it not for the violation of law, as applicable or as directed by the office of administrative hearings. Requires agencies to publicly post the justification for cancelling an invitation for bids or request for proposals; provided that the posting shall be for a minimum of ten business days a purchasing agency or provider internet site or by any other method the procurement officer deems effective for publicizing the cancellation notice. RELATING TO PROCUREMENT. Requires that any procurement change order that increases the contract cost by more than fifty per cent or substantially increases the scope of work be considered a new contract for procurement purpose. Effective 7/1/2050. (SD2)

RELATING TO PURCHASES OF HEALTH AND HUMAN SERVICES. Requires cost or pricing analysis for purchases of health and human services. Adds definition of "policy board." Increases the small purchase threshold for purchases of health and human services. Authorizes heads of purchasing agencies to issue requests for statement of qualifications and to establish lists of qualified providers for treatment purchase of services. Abolishes the Community Council for health and human services. Effective 7/1/2050. (SD1)

RELATING TO PARKING CONCESSIONS. Exempts parking lot operations and ground transportation services at airports and small boat harbors from the mandatory public bidding requirements under the state procurement law. (SD2)

RELATING TO PROCUREMENT. Authorizes the State Procurement Administrator to develop and administer procurement automation systems and assess, charge, and collect a transaction fee from all vendors using the procurement automation systems. Establishes the state procurement automation system special fund. Amends section 103D-1010, HRS, to conform with the amendments made to section 103D-1001, HRS, by Act 55, SLH 2021. Appropriates funds. Effective 7/1/2050. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
