RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION. Amends section 11-410, HRS, by: amending subsection (b) to provide that a person waives the right to a contested case hearing if the person fails to request a contested case hearing within twenty days of receipt of the Campaign Spending Commission’s preliminary determination; and amending subsection (d) to provide that a final order of the Commission may be filed in the First Circuit Court for confirmation as a civil judgment, enforceable and collectible as any other judgment issued in the circuit courts.

RELATING TO REPORTS FILED WITH THE CAMPAIGN SPENDING COMMISSION. Housekeeping measure that provides that candidates are not required to file preliminary general reports if they are either unsuccessful or are elected to office in the primary election. Amends subsections (b) and (c) of section 11-339, HRS, to make them consistent with subsection (a) by aggregating contributions and expenditures in determining whether a committee need only file the final election period report.

RELATING TO THE CAMPAIGN SPENDING COMMISSION. Requires the Campaign Spending Commission to file a complaint with the local office of the Federal Bureau of Investigation or Postmaster General as appropriate for grossly false or anonymous advertisements.

RELATING TO CAMPAIGN FINANCE. Authorizes candidates of inactive campaigns and their candidate committees to donate residual campaign funds to the State or the counties.

RELATING TO ELECTIONEERING COMMUNICATIONS. Requires a person to file a statement of information with the campaign spending commission for every expenditure for an electioneering communication.

RELATING TO ELECTIONS. Repeals the cap on the amount of campaign funds candidates may donate to any community service, educational, youth, recreational, charitable, scientific, literary organization, public school, or public library.

RELATING TO ELECTIONS. Allows the elections commission to refer a complaint to the attorney general or county prosecutor in addition to any administrative determination and without the requirement that the commission believes the respondent has recklessly, knowingly, or intentionally committed a violation. Disqualifies a person convicted of violating elections criminal prosecution laws from holding elective public office for ten years rather than four. Repeals language stipulating that elections criminal prosecution law does not apply to any persons who has paid or agrees to pay fines related to report filing violations and advertisement violations prior to the commencement of the proceedings.

RELATING TO THE APPRENTICESHIP AGREEMENT PREFERENCE. Repeals the public works construction bid preference for parties to registered apprenticeship agreements provided by section 103-55.6, Hawaii Revised Statutes.

RELATING TO GOVERNMENT CONTRACTS. Requires all departments and agencies to report the names of entities awarded a contract and the criteria used to select the awardee to the legislature no later than thirty days before a contract is effectuated.

RELATING TO THE HAWAII PUBLIC PROCUREMENT CODE. Establishes a working group within the department of accounting and general services to study and recommend to the legislature improvements to the management of the state procurement office and methods of procurement, particularly in the area of natural resource management. Requires a report prior to the convening of the regular session of 2023.

RELATING TO PROCUREMENT. Allows bidders to clarify or correct immaterial or technical information required as part of a bid submission for up to twenty-four hours after the bid submission deadline. Requires that bids for construction be opened no sooner than twenty-four hours after the deadline for the submission of bids. Defines "immaterial or technical information".

RELATING TO STATE PROCUREMENT REFORM. Requires procurement officers to document whether to pursue a design professional or contractor for damages in the event of construction cost overruns. Requires the chief procurement officer to compile a public list of construction companies or design professionals that are noncompliant or owe penalties. Makes construction cost overruns a tort for purposes of the design claim conciliation panel. Requires the state procurement office to include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards. Requires bids for a contract under the competitive sealed bidding process to include a liability contingency fund. Makes cost overruns a construction defect for the purposes of the contractor repair act. Establishes a procurement professional standards task force.

RELATING TO PURCHASES OF HEALTH AND HUMAN SERVICES. Requires cost or pricing analysis for purchases of health and human services. Adds definition of "policy board." Increases the small purchase threshold for purchases of health and human services. Authorizes heads of purchasing agencies to issue requests for statement of qualifications and to establish lists of qualified providers for treatment purchase of services. Abolishes the Community Council for health and human services.

RELATING TO THE PROCUREMENT OF PROFESSIONAL SERVICES. Amends section 103D-304(g), Hawaii Revised Statutes, to allow procurement of professional services where there are fewer than three qualified persons.

RELATING TO THE BOARD OF EDUCATION. Requires the Board of Education to hold no less than six community forums annually, with at least one forum in each county. Requires the Board to include an open forum for public comments on non-agenda items. Requires a report to the Legislature on implementing open forums.

RELATING TO ELECTIONS. Requires the Office of Elections to prepare a digital voter registration guide to be posted on its website. Requires the Office of Election to mail a notice with each ballot notifying voters that a voter information guide may be found on its website. Makes an appropriation.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
