Status

RELATING TO A WHISTLEBLOWER HOTLINE.

Requires the ombudsman to establish and manage a hotline by which an employee, or a person acting on behalf of an employee, may contact the office of the ombudsman directly to report a violation or suspected violation of a law, rule, ordinance, or regulation, or a contract executed by the State, a political subdivision of the State, or the United States.  Authorizes the ombudsman to receive and investigate reports of violations or suspected violations from the whistleblower hotline.

RELATING TO THE CONFIDENTIALITY OF THE AUDITOR'S WORK.

Requires the auditor to disclose information, evidence, and requested documents, including working papers, to an investigating committee after the final audit report has been issued.

RELATING TO AUDITING PRACTICES.

Establishes draft audit report requirements.  Requires the auditor to follow best auditing practices and standards when obtaining testimonial evidence and, if recording an interview, to follow certain requirements.

RELATING TO PROCUREMENT.

Allows bidders to clarify or correct immaterial or technical information required as part of a bid submission for up to twenty-four hours after the bid submission deadline.  Requires that bids for construction be opened no sooner than twenty-four hours after the deadline for the submission of bids.  Defines "immaterial or technical information".

RELATING TO PROCUREMENT.

Establishes the small business assistance initiative within the state procurement office, to consist of a small business procurement coordinator and small business office.  Appropriates funds.

RELATING TO PROCUREMENT.

Amends the nomination process and the number of the members for the Procurement Policy Board; authorizes the State Procurement Administrator to develop and administer procurement automation systems and assess, charge, and collect a transaction fee from all vendors using the procurement automation systems; establish a procurement automation system special fund; and amends section 103D-1010, Hawaii Revised Statutes (HRS), to conform with the amendments made to section 103D-1001, HRS.

Status

RELATING TO STATE PROCUREMENT REFORM.

Requires procurement officers to document whether to pursue a design professional or contractor for damages in the event of construction cost overruns.  Requires the chief procurement officer to compile a public list of construction companies or design professionals that are noncompliant or owe penalties.  Makes construction cost overruns a tort for purposes of the design claim conciliation panel.  Requires the state procurement office to include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards.  Requires bids for a contract under the competitive sealed bidding process to include a liability contingency fund.  Makes cost overruns a construction defect for the purposes of the contractor repair act.  Establishes a procurement professional standards task force.

HB 2071

Status

RELATING TO PURCHASES OF HEALTH AND HUMAN SERVICES.

Requires cost or pricing analysis for purchases of health and human services.  Adds definition of "policy board."  Increases the small purchase threshold for purchases of health and human services.  Authorizes heads of purchasing agencies to issue requests for statement of qualifications and to establish lists of qualified providers for treatment purchase of services. Abolishes the Community Council for health and human services.

RELATING TO THE PROCUREMENT OF PROFESSIONAL SERVICES.

Amends section 103D-304(g), Hawaii Revised Statutes, to allow procurement of professional services where there are fewer than three qualified persons.

RELATING TO HAWAII CORRECTIONAL INDUSTRIES.

Provides that any goods provided to any state agency by the correctional industries program shall be:  (1) produced or manufactured by the program; or (2) pre-existing goods that are substantially altered or customized by the program for the purpose of facilitating use of the goods by a state agency.

RELATING TO THE BOARD OF EDUCATION.

Requires the Board of Education to hold no less than six community forums annually, with at least one forum in each county.  Requires the Board to include an open forum for public comments on non-agenda items.  Requires a report to the Legislature on implementing open forums.

RELATING TO ELECTIONS.

Requires the Office of Elections to prepare a digital voter registration guide to be posted on its website.  Requires the Office of Election to mail a notice with each ballot notifying voters that a voter information guide may be found on its website.  Makes an appropriation.

Status

RELATING TO PERSONS WORKING WITH CHILDREN.

Establishes rules of ethics applicable to persons who work with children pursuant to a contract with the State.  Requires recommendations made to tribunals to base any factual findings on the relevant legal standard of proof applicable to the matter.  Provides that the contracts of any person who violates the rules of ethics are voidable on behalf of the State.

Status

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW.

Increases from $1,000 to $5,000 the fine that may be assessed for campaign spending law violations against a noncandidate committee making only independent expenditures and that has received at least one contribution of more than $10,000, or spent more than $10,000 in an election period.  Allows the Campaign Spending Commission to order that the fine be up to three times the amount of the unlawful contribution or expenditure, and that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

Housekeeping measure that repeals references in sections 11‑322(b) and 11‑323(b), HRS, to paragraphs in subsection (a) of those statutes that have been repealed.

Status

RELATING TO ELECTIONEERING COMMUNICATIONS.

Increases the threshold amount of aggregated expenditures for electioneering communications in a calendar year from more than $1,000 to more than $2,000 before statements of information would be required.  Amends the definition of "disclosure date" to the date the electioneering communication is publicly distributed and the date of any subsequent public distributions of electioneering communications during the calendar year.  Repeals "actual expenditures" from the list of items that are not electioneering communication.

RELATING TO AGRICULTURE.

Changes the law requiring all state departments to ensure that a certain percentage of food purchased consists of fresh, local agricultural products or local value-added, processed, agricultural, or food products to apply only to the DOE, DOH, PSD, and UH System.  Requires each of those departments and the UH System to report to the legislature on its progress toward meeting these benchmarks and clarifies the information to be reported.

Exempts parking concessions from the public bidding requirements under the state procurement law.

RELATING TO OPIOIDS.

Requires the Department of Health to implement standardized quality metrics to track and address health care processes or outcomes applicable to improving the quality of care for patients having opioid use disorders and targeting through value-based purchasing improvements in outcomes for patients having opioid use disorders.  Requires the Department of Health to implement value-based purchasing based on the standardized quality metrics.  Directs the Department of Health to collect data on levels of opioid prescriptions, use of opioids in healthcare settings, and patient interactions for opioid use disorders.  Requires annual reports to the Legislature.

RELATING TO STATE SELF-INSURANCE AGAINST PROPERTY AND CASUALTY RISKS.

Establishes the State self-insurance against property and casualty risks special fund to be administered by the comptroller to provide the State with self-insurance against the State's property and casualty risks.  Appropriates funds.

RELATING TO STATE BOARDS AND COMMISSIONS.

Requires certain information on the financial disclosure statements deemed to be public records for non-paid volunteer members of state boards and commissions to be redacted.

RELATING TO CAMPAIGN FINANCE.

Requires the maintenance of transfer records relating to certain campaign contributions and transfers.  Requires certain covered persons to seek permission from contributors to use of transfer contributed funds for independent campaign spending.  Requires certain major contributors to disclose and maintain relevant records relating to the identities of other contributors.  Requires certain covered persons to file disclosure reports with the Campaign Spending Commission.  Facilitates the identification of certain top contributors of funds for certain political advertisements.  Prohibits structured transactions.

RELATING TO ELECTIONEERING COMMUNICATIONS.

Specifies the disclosure date for subsequent expenditures for electioneering communications.  Requires that disclosures of electioneering communications occur on the date the electioneering communications are publicly distributed.  Applies to all elections beginning with the 2022 primary election.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
