RELATING TO THE GENERAL FUND. Provides a tax credit to taxpayers and makes deposits to the emergency and budget reserve fund and other post-employment benefits trust fund pursuant to article VII, section 6, of the Hawaii Constitution. Appropriates funds. (SD1)

RELATING TO TAXATION. Clarifies that amounts received or accrued for wharfage and demurrage services are exempt under the general excise tax law. Clarifies that amounts received for the transportation or storage of cargo are not exempt under the general excise tax law. Effective 1/1/2050. (SD2)

RELATING TO MEDICAID PATIENT CARE. Appropriates funds to provide for a one-time enhanced payment equal to 15 per cent of Medicaid patient payments of fiscal year 2022-2023 made to any eligible facility in the State, as determined by the department of human services, that provides care to medicaid patients in medicare-certified nursing facility, community care foster family homes, and expanded adult residential care homes, to assist with pandemic-related costs and lost revenues. Requires the department of public safety, in collaboration with the office of Hawaiian affairs, to create a Native Hawaiian rehabilitation program for prison inmates that emphasizes Native Hawaiian values and cultural practices. RELATING TO THE JUDICIARY. Appropriates funds for residential programs that allow minor children to remain with their mothers while participating in the program, to reduce the risk of trauma and multigenerational incarceration, including community‑based furlough programs, residential drug treatment programs, therapeutic community programs, and mental health programs. RELATING TO ASSISTANCE FOR PERSONS COMPLETING A TERM OF IMPRISONMENT. Establishes within the judiciary a five-year recidivism prevention pilot program consisting of three components: a housing voucher program, child care voucher program, and employer income tax credit program to assist the reentry efforts of certain individuals who exited the women's community correctional center. Appropriates funds for the program and five transition navigator positions within the judiciary. Effective 7/1/3000. Repeals 7/1/2027. (HD2)

RELATING TO THE COMPREHENSIVE OFFENDER REENTRY SYSTEM. Requires the offender reentry office of the department of public safety to develop and implement a risk needs assessment tool that is specifically intended to assess the needs of women offenders. RELATING TO RISK AND NEEDS ASSESSMENT FOR FEMALE OFFENDERS. Requires the department of public safety to develop a pretrial female risk and needs assessments tool and conduct internal female risk and needs assessments to measure female offenders' risk of flight, reoffending, or harm to the community. Requires the pretrial female risk and needs assessment tool to consider factors important to women when considering their risks of reoffending and their treatment needs. Effective 7/1/3000. (HD1)

RELATING TO CORRECTIONS. Establishes the women's corrections implementation commission within the department of public safety to provide oversight over state correctional facilities and community correctional centers that incarcerate women; receive and investigate complaints from incarcerated women; monitor the criminal justice system's progress in implementing reforms; and monitor programs and data that are important to ensuring successful outcomes for women in the correctional system. Requires annual reports to the legislature. Appropriates funds. Effective 7/1/2050. (HD2)

RELATING TO THE HAWAII CODE OF MILITARY JUSTICE. Adopts a new Hawaii Code of Military Justice to promote order and discipline in the state military forces by fostering an independent military justice system and updating nonjudicial punishment and courts-martial procedures. Effective 1/1/2222. (HD2)

RELATING TO PUBLIC PARTICIPATION IN GOVERNMENT. Repeals the Citizen Participation in Government Act. Enacts the Uniform Public Expression Protection Act. Effective 7/1/2112. (HD2)

RELATING TO PUBLIC PROCUREMENT. Authorizes the office of administrative hearings, where it is determined that an award of a contract is in violation of law and the award is rescinded and the contract, if executed, is terminated or declared null and void, to award the government contract to the next lowest bidder or next responsible offeror, if certain conditions are met. Effective 7/1/2112. (HD2)

RELATING TO FRANCHISE TAX. Ensures that the $2,000,000 franchise tax payment is credited in full to the compliance resolution fund for use by the division of financial institutions. Specifies that if franchise tax collections are insufficient, the difference will be derived from income tax collections. Clarifies that franchise tax revenues in excess of $2,000,000 shall be deposited into the general fund. Effective 7/1/2050. (HD1)

RELATING TO THE MORTGAGE LOAN RECOVERY FUND. Allows a person aggrieved by the fraud, misrepresentation, or deceit of a mortgage loan originator company licensee to receive restitution payment upon a final court order. Repeals fees paid by mortgage loan originator companies and their branch office locations to the mortgage loan recovery fund. Provides the commissioner of financial institutions with the authority to consider applications to recover from the fund. Effective 1/1/2050. (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
