RELATING TO THE SAFETY OF JUDICIARY PERSONNEL.

Prohibits the posting of judges' and other court staff's personal information on the Internet with the intent to intimidate or threaten.  Establishes a judicial security task force to review and recommend additional measures to enhance the security of judges and judiciary personnel.  (HD1)

Appropriates funds for a program coordinator and various services to support the judiciary's ‘Olelo Hawai‘i initiatives.  Effective 1/1/2222.  (HD1)

RELATING TO ELECTRONIC CITATIONS.

Creates an electronic citation program under the judiciary and establishes an electronic citation surcharge.  Appropriates funds.  Effective 1/1/2023.

RELATING TO PROFESSIONALLY LICENSED OR CERTIFIED GOVERNMENT EMPLOYEES.

Clarifies that the State shall be exclusively liable for claims for injury or loss of property, or personal injury or death, resulting from the negligent or wrongful act or omission of any professionally licensed or certified employee of the State while acting within the course and scope of the employee's office or employment.  Precludes civil actions or proceedings for money damages against the employee, except for claims based on liability other than an employee's course and scope of employment with the State or other employer.  Clarifies liability when the State agrees to assume full or partial responsibility in a civil action against a professional licensed or certified employee.

Clarifies applicable reimbursement to the State or a defendant for expert witness fees, as it pertains to testimony, preparation, and in-court attendance in state court criminal proceedings.

RELATING TO LIFEGUARDS.

Exempts county lifeguards, the employing counties, and the State from liability for any civil damages resulting from any act or omission of the county lifeguard while providing lifeguard services unless the civil damages result from a county lifeguard's gross negligence or wanton act or omission.  (HD1)

RELATING TO TRAFFIC FINES.

Authorizes each county to establish a county highway enforcement program.  Requires annual reports on the status and progress of the program.  Imposes a surcharge for illegally stopping, standing, or parking vehicles on county highways to be distributed to county police departments.  (HD1)

RELATING TO CONDOMINIUMS.

Requires buildings and structures to be maintained in a safe and sanitary condition.  Requires devices and safeguards to be maintained in conformance with county building codes.  Requires condominium associations or their designated agents to be responsible for the maintenance of the buildings and structures.  Authorizes county building officials to require a building or structure to be reinspected.  Effective 1/1/2050.  (HD1)

RELATING TO PUBLIC SAFETY.

Establishes a department of law enforcement to consolidate and administer criminal law enforcement and investigations functions of the State effective upon approval and reestablishes the department of public safety as an independent department of corrections and rehabilitation to administer the corrections, rehabilitation, and reentry of the inmate population effective 1/1/2023.  Transfers the law enforcement functions of the department of public safety to the department of law enforcement effective 1/1/2023, and the law enforcement functions of the department of transportation, the non-statutorily mandated functions of the investigations division of the department of the attorney general, and the office of homeland security to the department of law enforcement effective 7/1/2023.  Establishes a training center.  Appropriates funds.  Effective 7/1/3000.  (HD2)

RELATING TO ECONOMIC DEVELOPMENT.

Requires the department of business, economic development, and tourism to promote the acquisition of appropriate patents and copyrights for "Hawaii Made" products and to conduct a study and prepare a plan for the promotion and enforcement of either a "Hawaii Made" or "Made in Hawaii" program and evaluate which name to use.  Appropriates funds.  Effective 10/18/2050.  (HD1)

Requires the state public charter school commission to disburse funds directly to public charter schools.  Repeals the exemption for charter schools from requirements on the administration and use of the federal funds allocated to the State for public education purposes.  Effective 7/1/2050.  (HD1)

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST NEXT LEVEL SOLUTIONS GROUP INC.

Authorizes the issuance of special purpose revenue bonds to assist Next Level Solutions Group Inc., in developing a waste-to-energy facility.  Effective 7/1/2100.  (HD1)

RELATING TO A DEPARTMENT OF ENVIRONMENTAL PROTECTION.

Establishes a department of environmental protection on July 1, 2026.  Creates a department of environmental protection working group to address the logistics required for the State to establish a department of environmental protection.  Requires the working group to submit a report to the legislature prior to the 2025 regular session.  Effective 7/1/2100.  (HD1)

RELATING TO BUILDING INDUSTRY PROFESSIONALS.

Updates the cost valuations of work on buildings for the work to qualify for an exemption from the requirement that plans and specifications for construction projects be prepared by a licensed engineer or architect.  (HD1)

RELATING TO SEA LEVEL RISE ADAPTATION.

Requires the office of planning and sustainable development to establish a pilot program to develop a Waikiki adaptation and resilience plan to address climate change and sea level impacts in the Waikiki special district.  Requires reports to the legislature.  Makes an appropriation.  Effective 7/1/2050.  (HD1)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
