RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Establishes the Hawaiian home lands special fund.  Appropriates funds into and out of the special fund for DHHL to enable beneficiaries of the Hawaiian home lands trust to acquire a residence and to enable DHHL to fulfill its fiduciary duties to beneficiaries.  (HD1)

RELATING TO CHILD PASSENGER RESTRAINT SYSTEMS.

Requires motor vehicle operators to ensure that children two years of age or younger are properly restrained in rear-facing child passenger restraint systems.  Requires the use of child safety seats or booster seats for certain children less than ten years of age.  (HD1)

Requires the exterior of the envelope containing the ballot package for elections by mail to include instructions on how to obtain language translation services in Hawaiian and certain other non-English languages.  Applies to all elections beginning with the 2022 primary election.  Effective 1/1/2222.  (HD1)

Status

RELATING TO PROPERTY FORFEITURE.

Restricts civil asset forfeiture to cases involving the commission of a covered offense where the person exercising some degree of control over the property is charged with an offense related to the property.  Raises the State's standard for forfeiture to clear and convincing evidence.  Authorizes the use of certain forfeited property by local or state agencies for a limited time.  Directs forfeiture proceeds to certain involved state and local governments and to the general fund.  Amends the allowable expenses for moneys in the criminal forfeiture fund.  Amends the requirements for the attorney general to adopt rules and report on the Hawaii omnibus criminal forfeiture act.  Effective 1/1/2222.  (HD1)

PROPOSING AMENDMENTS TO ARTICLE VII, SECTIONS 12 AND 13, OF THE HAWAII CONSTITUTION TO EXPRESSLY PROVIDE THAT THE LEGISLATURE MAY AUTHORIZE THE COUNTIES TO ISSUE TAX INCREMENT BONDS AND TO EXCLUDE TAX INCREMENT BONDS FROM DETERMINATIONS OF THE FUNDED DEBT OF THE COUNTIES.

Proposes amendments to the Constitution of the State of Hawaii to expressly provide that the legislature may authorize political subdivisions, such as counties, to issue tax increment bonds and to exclude tax increment bonds in calculating the debt limit of the political subdivisions.

Status

RELATING TO CONCESSIONS ON PUBLIC PROPERTY.

Increases the maximum term of a concession.  Exempts concessions for beach or ocean-related recreational services from sealed bid requirements, with certain conditions.  Provides that a county director of parks and recreation has sole discretion to designate which county parks are environmentally, culturally, historically, or operationally unique for purposes of determining whether a concession at the park is exempt from the sealed bid requirements.  Expands the exemption for concessions at county zoos, botanic gardens, or county parks that are designated by the respective county director of parks and recreation, in the director's sole discretion, as environmentally, culturally, historically, or operationally unique; provided that the concessions are awarded to responsible offerors whose proposals are the most advantageous, rather than solely to certain nonprofit corporations.  Effective 1/1/2050.  (HD1)

RELATING TO COMMERCIAL DRIVER'S LICENSES.

Repeals the requirement that a person only operates category 3 vehicles to qualify to drive commercially in the State.  Repeals the requirement that an application for a commercial driver's license or commercial learner's permit include intrastate driver certification.  Requires the department of transportation to amend its rules, and makes conforming statutory amendments, to lower the minimum age required for a commercial driver's license.  Effective 1/1/2050.  (HD2)

RELATING TO THE STATE BUILDING CODE COUNCIL.

Requires the state building code council to consult with building industry trade associations to gather cost data on the implementation of certain building codes or standards and calculate the financial impact of those codes and standards, including amortized utility costs, on the cost of single-family and multi-family homes built in the State.  Requires the annual report to the governor to include the cost provided by building industry trade associations on certain codes and standards adopted by the council.  Effective 1/1/2050.  (HD1)

RELATING TO EDUCATION.

Beginning 1/1/2024, authorizes public schools and public charter schools to have an employee trained to administer or assist with the self-administration of seizure disorder rescue medication, with certain exemptions.  Authorizes all principals, guidance counselors, and teachers to perform an annual self-review of seizure disorder materials.  Allows a seizure action plan for every diagnosed student to be established and distributed to employees charged with supervising the student.  Appropriates funds.  Effective 7/1/2051.  (HD2)

RELATING TO COLLECTIVE BARGAINING.

Requires the representative of labor on the Hawaii labor relations board to be a person selected by a majority of the exclusive representatives of the collective bargaining units.  Provides a timeframe for the governor to appoint the representative of labor following submission of the nominee's name.  Effective 12/25/2040.  (HD2)

RELATING TO INCOME.

Part II:  Makes the state earned income tax credit refundable and permanent.  Provides for carryforward of nonrefundable credits previously claimed.  Part III:  Increases and amends the refundable food/excise tax credit.  Part IV:  Increases minimum wage rate to $11.00 per hour beginning on 1/1/2023, $12.00 per hour beginning on 1/1/2024, $13.00 per hour beginning on 1/1/2025, $14.00 per hour beginning on 1/1/2026, $15.00 per hour beginning on 1/1/2027, $16.00 per hour beginning on 1/1/2028, $17.00 per hour beginning on 1/1/2029, and $18.00 per hour beginning 1/1/2030.  Increases the tip credit over the same period.  Beginning 7/1/2030 and each year thereafter, requires DLIR to annually adjust the minimum wage hourly rate and tip credit amount for the following January 1 based on the average of the increases to the statewide median hourly wage for all occupations over the previous three years compiled by the United States Bureau of Labor Statistics.  Part V:  Amends the household and dependent care tax credit to apply to expenses paid for the care of a qualifying individual, regardless of age.  Part VI:  Increases the cap on revenues that may be deposited into the tax administration special fund and authorizes that moneys in the fund shall also be used for outreach to educate low-wage earners about their withholding options and to provide support when completing their withholding forms.  Appropriates funds from the tax administration special fund for the purpose of this part.  Effective 12/25/2040.  (HD1)

Appropriates funds to help Hawaii's food banks meet the significantly heightened need for food assistance during the COVID-19 pandemic.  Effective 7/1/2050.  (HD1)

RELATING TO INVASIVE SPECIES.

Requires the division of forestry and wildlife of the department of land and natural resources to establish a two-year pilot program to remove invasive species in and around Waiahole stream on Oahu.  Effective 7/1/2050.  (HD1)

RELATING TO DISTRICT BOUNDARY AMENDMENTS.

Authorizes the appropriate county land use decision-making authority to determine district boundary amendments involving land areas over fifteen acres but less than or equal to fifty acres if the county has adopted an ordinance that meets certain requirements, including the requirement that the district boundary amendment is necessary to produce housing, sixty per cent of which shall be reserved for occupants whose incomes do not exceed eighty per cent of the area median income.  Prohibits parceling of such lands.  7/1/2050.  (HD1)

Status

RELATING TO COASTAL EROSION.

Establishes and appropriates moneys for a two-year program at the University of Hawaii to study the impact of sandbag walls, or "sand burritos", on sand movement patterns and coastal erosion and on public trust resources, including beach access, coastal water quality, and recreation, at Ehukai Beach Park; including from the shoreline area near Ke Ike road to Sunset beach.  Effective 7/1/2050.  (HD1)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.
