RELATING TO STATE SELF-INSURANCE AGAINST PROPERTY AND CASUALTY RISKS.

Establishes the State self-insurance against property and casualty risks special fund to be administered by the comptroller to provide the State with self-insurance against the State's property and casualty risks.  Appropriates funds.  Effective 7/1/2112.  (HD1)

RELATING TO PROCUREMENT.

Allows bidders to clarify or correct immaterial or technical information required as part of a bid submission for up to twenty-four hours after the bid submission deadline, in addition to the time for correction or withdrawal of inadvertently erroneous bids before or after the award as permitted by rules adopted by the procurement policy board.  Requires that bids for construction be opened no sooner than twenty-four hours after the deadline for the submission of bids.  Defines "immaterial or technical information".  Repeals 6/30/2024.  Effective 7/1/2112.  (HD2)

Establishes the small business assistance initiative within the state procurement office, to consist of a small business procurement coordinator and small business office.  Appropriates funds.  Effective 7/1/2112.  (HD1)

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW.

Increases the fine that may be assessed for campaign spending law violations against a noncandidate committee making only independent expenditures and that has received at least one contribution of more than $10,000, or spent more than $10,000 in an election period.  Allows the campaign spending commission to order that the fine be up to three times the amount of the unlawful contribution or expenditure, and that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.  Effective 7/1/2112.  (HD1)

RELATING TO ELECTIONEERING COMMUNICATIONS.

Increases the threshold amount that requires disclosure of electioneering communications.  Requires that disclosures of electioneering communications occur on the date the electioneering communications are publicly distributed.  Specifies the disclosure date for subsequent public distribution of electioneering communications.  Exempts communications in news stories or editorials published by electronic means from being considered electioneering communications.  Repeals the actual expenditures exception from the definition of "electioneering communication".  Applies to all elections beginning with the 2022 primary election.  Effective 7/1/2112.  (HD2)

Appropriates funds to the judiciary to contract with non-profit organizations to provide legal counsel and assistance to low-income immigrants.

RELATING TO THE COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN.

Requires the department of the attorney general to provide annual reports to the legislature on available data pertaining to the commercial sexual exploitation of children.  Appropriates moneys.  (HD1)

RELATING TO TOBACCO MANUFACTURER QUALIFIED ESCROW FUNDS.

Provides a mechanism to assign nonparticipating tobacco manufacturers' qualified escrow fund balances to the State.  Provides a mechanism for the financial institution acting as the escrow agent of the qualified escrow fund to petition the courts to authorize transfer of funds to the State when the qualified escrow fund is abandoned.  Effective 1/1/2222.  (HD1)

RELATING TO MARRIAGE LICENSES.

Establishes a fee for all licenses to solemnize a marriage.  Allows DOH to increase the fee, subject to certain requirements.  Requires DOH to account for the collection and deposit of the fee.  Repeals the expiration of and fees specific to civil licenses to solemnize marriages.  (HD1)

RELATING TO INVASIVE SPECIES.

Establishes a pilot program within the Aina Mauna legacy program of the department of Hawaiian home lands to remove and harvest gorse from Mauna Kea and develop it as a marketable product to expand economic opportunities for native Hawaiians.  Requires reports to the legislature.  Appropriates funds.  Sunsets 6/30/2025.  (HD1)

RELATING TO CRIMINAL PROCEDURE.

Specifies under the Hawaii Rules of Evidence that a court may order that the testimony of witnesses be taken through a live two-way video connection in certain circumstances.  Effective 1/1/2222.  (HD1)

RELATING TO CRIMINAL PRETRIAL REFORM.

Eliminates the use of monetary bail and requires defendants to be released on their own recognizance for certain nonviolent offenses, subject to exceptions.  Requires PSD to take steps to provide videoconferencing to a defendant who chooses to participate in a bail report interview via videoconference.  Effective 1/1/2222.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
