RELATING TO NATURAL RESOURCE MANAGEMENT.

Establishes within the Department of Land and Natural Resources a visitor impact fee program to collect a fee to allow visitors to visit a state park, beach, state-owned forest, hiking trail, or other state-owned natural area.  Establishes the Environmental Legacy Commission to allocate the revenues from the visitor impact fee to protect and manage Hawaii's natural resources.  Establishes the visitor impact fee special fund.  Appropriates moneys.  Takes effect 7/1/2050.  (SD2)

Status

RELATING TO GEOTHERMAL ROYALTIES.

Caps the amount of royalties from geothermal resources that are to be paid to the State and to the county in which the geothermal resources are located.  Establishes the University of Hawaii Geothermal Exploration Special Fund for the Hawaii Groundwater and Geothermal Resources Center to further the discovery and development of geothermal resources.  Requires the entities that received geothermal royalties to submit an annual report to the Legislature.  Effective 7/1/2050.  (SD2)

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Appropriates moneys to the Department of Hawaiian Home Lands for the investigation, exploration, and identification of geothermal resources on Hawaiian home lands.  Effective 7/1/2050.  (SD2)

RELATING TO RECYCLING.

Requires the Department of Health to implement the Auditor's recommendations for the Deposit Beverage Container program, including developing a risk-based selection process to select reports submitted by certain distributors and redemption centers for audit.  (SD1)

RELATING TO ENVIRONMENTAL SUSTAINABILITY.

Establishes a reusable utensil pilot project in Department of Education schools on Molokai.  Requires the Department of Education to submit an interim report and a final report to the Legislature on the feasibility of statewide implementation.  Appropriates moneys.  Effective 7/1/2050.  (SD2)

RELATING TO MICROBEADS.

Beginning 7/1/2022, bans the manufacture of a personal care product, except a non-prescription drug, that contains plastic microbeads.  Beginning 7/1/2023, bans the sale or offer for sale of a personal care product, except a non-prescription drug, that contains plastic microbeads.  Beginning 7/1/2024, bans the sale or offer for sale of a non-prescription drug that contains plastic microbeads.  Specifically exempts rinse-off cosmetics that are also non-prescription drugs regulated by the federal Microbead-Free Waters Act of 2015.  Effective 7/1/2050.  (SD1)

RELATING TO CONSTRUCTION WASTE.

Requires state building codes to incorporate the international green construction code.  Sets specific targets for the recycling, reuse, donation, and resale of non-hazardous construction waste.  Effective 7/1/2050.  (SD2)

RELATING TO CARBON SEQUESTRATION INCENTIVES.

Establishes the Hawaii farmland and forest soil health carbon smart incentive program to incentivize carbon sequestration activities through incentive contracts that provide compensation for eligible practices by program participants.  Appropriates funds for positions and for administering the program.  Effective 7/1/2050.  (SD2)

RELATING TO THE DEPARTMENT OF THE ATTORNEY GENERAL.

Establishes and funds an environmental investigative hotline pilot project through the Department of the Attorney General, Investigations Division, that will implement and manage an investigative hotline for Molokai residents to report environmental concerns on Molokai and have one full time investigator on the island of Molokai to investigate environmental concerns.  Takes effect 7/30/2075.  (SD1)

Status

RELATING TO SPECIAL PURPOSE REVENUE BONDS TO ASSIST THE HAWAIIAN LEGACY REFORESTATION INITIATIVE TO RESTORE HAWAII'S FORESTS AND NATURAL RESOURCES.

Authorizes the Department of Budget and Finance to issue special purpose revenue bonds to assist Hawaiian Legacy Reforestation Initiative, LLC in its mission to proliferate a sustainable model of endemic reforestation, ecosystem revitalization, endangered species recovery, and carbon credit sequestering.  Effective 7/1/2050.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
