RELATING TO RECYCLING. Changes the Electronic Waste and Television Recycling and Recovery Act to the Electronic Device Recycling and Recovery Act. Establishes electronic device manufacturer recycling goals and record keeping and reporting requirements for manufacturers and collectors. Requires collectors to register with the department of health. Amends and repeals various definitions, including repealing "covered electronic device" and "covered television" and creating a new "electronic device" definition. Expands the recycling and collection requirements of televisions to all electronic devices. Requires the recycling electronic device program to include, among other things, a description of the methods for the convenient collection of electronic devices.

RELATING TO ENVIRONMENTAL PROTECTION. Beginning July 1, 2023, bans the manufacture, sale, distribution, and use of wraps and liners, plates, food boats, pizza boxes, and firefighting foams that contain perfluoroalkyl and polyfluoroalkyl substances (PFAS).

RELATING TO RECYCLING. Requires the department of health to implement the auditor's recommendations for the deposit beverage container program, including developing a risk-based selection process to select reports submitted by distributors and redemption centers for audit.

RELATING TO SINGLE-USE PLASTICS. Prohibits the manufacture, distribution, and sale of single-use plastic bottles and rigid plastic containers designed to hold 16 fluid ounces or less, effective 1/1/2024, and single-use plastic bottles and rigid plastic containers designed to hold more than 16 fluid ounces, effective 1/1/2025.

RELATING TO WASTE REDUCTION. Beginning January 1, 2023, allows a food vendor to provide or distribute disposable service ware for prepared food or for a beverage only upon the request or affirmative response of a customer or person being provided the prepared food or beverage, or in a self-service area or dispenser.

RELATING TO POSTCONSUMER RECYCLED CONTENT. Requires deposit beverage distributors, glass container importers, and distributors or importers of beverage containers that sell, offer for sale, or distribute beverage containers in the State to meet minimum postconsumer recycled content requirements, beginning with a 12/31/2026 deadline.

RELATING TO RECYCLING. Establishes the packaging stewardship program within the department of health to reduce the amount of packaging material that becomes solid waste.

RELATING TO WASTE MANAGEMENT. Establishes an extended producer responsibility program. Requires certain producers of fast-moving consumer goods to register with the Department of Health and pay an annual fee based on the amount of packaging volume the covered producer places on the market each calendar year from 2023 to 2027. Provides for the deposit of fees into an extended producer responsibility special fund. Provides for the expenditure of moneys from the extended producer responsibility special fund for the creation of a report that assess the resources needed to reduce the volume of packaging waste sent to landfills or power plants that burn municipal solid waste as a fuel by 50% by 2026 and 80% by 2030. Appropriates moneys.

RELATING TO THE ENVIRONMENT. Prohibits the sale or distribution of consumer goods for which a deceptive claim about the recyclability of the product or packaging is made. Requires the department of health to collect data and issue a material characterization study on recyclable materials collected in the State. Establishes standards for recyclability of products in the State. Prohibits the sale of any product that is labeled as compostable or biodegradable unless the product meets specified criteria.

RELATING TO CESSPOOLS. Establishes a cesspool compliance pilot grant project to assist low- and moderate-income property owners with the costs of upgrading, converting, or connecting a cesspool. Applies to cesspools identified as failing by the Department of Health. Appropriates funds.

RELATING TO FINANCING. Creates the environmental and economic development revolving loan fund under the administration of the Hawaii Green Infrastructure Authority. Allows property owners to finance qualified improvements through a non-ad valorem property assessment. Appropriates funds.

RELATING TO MUNICIPAL SOLID WASTE LANDFILL PERMITS. Clarifies that federal municipal solid waste landfills are subject to Department of Health permitting.

RELATING TO WATER POLLUTION CONTROL. Adds, amends, and re-organizes sections in chapter 342D, Hawaii Revised Statutes, to include wetlands in the definition of State waters; clarifies the Director of Health's responsibility as a certifying agency; and increases maximum statutory civil penalties to match the amounts of federal penalties and the state penalty in section 342B-47(d), Hawaii Revised Statutes.

RELATING TO LANDFILLS. Reduces the landfill buffer zone from one-half mile to one-quarter mile.

RELATING TO WASTE OR DISPOSAL FACILITIES. Prohibits the construction, modification, or expansion of any waste or disposal facility on land that covers a significant aquifer as determined by the department of health.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
