RELATING TO THE GENERAL EXCISE TAX. Clarifies that, under the general excise tax law, sales to a licensed retail merchant, jobber, or other licensed seller for resale are only eligible for the wholesale tax rate if the resale is subject to the highest general excise tax rate. Adds a similar requirement for sales of tangible personal property to a service provider or for the purpose of providing transient accommodations.

RELATING TO REGULATION. Prohibits as an unfair and deceptive practice the advertisement of a good or service in the absence of licenses or permits for the good or service, to the extent the licenses or permits are required by applicable state and county laws.

RELATING TO LIQUOR. Beginning July 1, 2022, establishes a $0.10 per drink surcharge in addition to the liquor tax.

RELATING TO BROADBAND SERVICE INFRASTRUCTURE. Allows an electric utility to own, operate, lease, plan, construct, install, maintain, and/or replace broadband facilities, including middle mile infrastructure, to help facilitate the development of and investment in broadband facilities and services to rural, unserved, underserved, and urban communities throughout the State.

RELATING TO THE TAXATION BOARD OF REVIEW. Reduces the size of the Taxation Board of Review from 10 members to 3, with at least 2 members required for quorum. Establishes that the members shall be full-time employees, with compensation based on a percentage of the salary of the director of taxation. Authorizes the members of the Taxation Board of Review to validate the board's actions with a concurrence of the majority of members who heard the appeal. Clarifies that board meetings are contested case hearings and provides notice requirements. Clarifies the legal and evidentiary framework the board shall use in reaching its decisions. Appropriates moneys to the Department of Taxation to establish 3 full-time equivalent Taxation Board of Review members and 2 full-time equivalent staff positions.

RELATING TO AN INTERSTATE COMPACT TO PHASE OUT CORPORATE WELFARE. Adopts the Interstate Compact to Phase Out Corporate Welfare.

RELATING TO NONPROFIT ORGANIZATIONS. Clarifies the GET exemption for unrelated trade or business activities of nonprofit organizations.

RELATING TO TAXATION. Reinstates the renewable fuels production tax credit.

RELATING TO MOTION PICTURE, DIGITAL MEDIA, AND FILM PRODUCTION. Prohibits a production from qualifying for the motion picture, digital media, and film production tax credit if the production hires or compensates an employee of the State or county whose official capacity is related to motion picture, digital media, or film production for certain services. Requires a taxpayer claiming the tax credit to identify any such employee in the statement submitted to DBEDT.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair will be instituting a 2- minute per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
