RELATING TO SUNSCREEN.

Prohibits, beginning 1/1/2023, the sale, offer for sale, or distribution in the State of any sunscreen that contains active ingredients that are not generally recognized as safe and effective by the Food and Drug Administration, without a prescription issued by a licensed health care provider.  Effective 1/1/2050.  (SD1)

RELATING TO MICROBEADS.

Beginning 7/1/2022:  bans the manufacture of a personal care product, except a non-prescription drug, that contains plastic microbeads.  Beginning 7/1/2023:  bans the sale or offer for sale of a personal care product, except a non-prescription drug, that contains plastic microbeads and bans the manufacture of a non-prescription drug that contains plastic microbeads.  Beginning 7/1/2024:  bans the sale or offer for sale of a non-prescription drug that contains plastic microbeads.  Specifically exempts rinse-off cosmetics and rinse-off cosmetics that are also non-prescription drugs regulated by the federal Microbead-Free Waters Act of 2015.

Requires farm owners or operators to confine egg-laying hens in accordance with the standards established in this measure. Effective 6/30/27, prohibits a business owner or operator from selling shell eggs or egg products that are produced by egg-laying hens that were confined in a cruel manner, with exceptions.  (SD1)

Allows counties to prohibit discrimination against renters based on their source of income.

RELATING TO NOISE CONTROL.

Enhances the control of low-frequency noise emitted from establishments regulated by county liquor commissions by setting a maximum permissible noise level in dBC measurements.  Clarifies that emission of noise that exceeds the maximum permissible noise level constitutes a noise violation.  Allows noise violations to be enforced by summons or citation issued by law enforcement officers.  Allows county liquor commissions to adopt rules to issue fines for noise violation.  Allows county liquor commissions to revoke or suspend a liquor license, deny the application, renewal, or transfer of a license, or withhold issuance of a license when the licensee or applicant fails to take corrective action to address noise complaints or violations.  (SD1)

RELATING TO NOISE.

Prohibits commercial vehicles from making pickups from, or deliveries to, business establishments during certain times of the day and within a certain proximity of single-family residences in the performance of the vehicles' pickup or delivery.  Exempts commercial vehicles operating in response to an emergency.  Establishes fines.  Effective 1/1/2050.  (SD1)

RELATING TO ABORTION CARE.

Clarifies that access to abortion care is inclusive of all pregnant people in the State.  Repeals a criminal penalty for violations of certain abortion provisions.  Clarifies that advanced practice registered nurses may provide abortion care.  (SD1)

Streamlines the records review process for physician assistants by including review of physician assistants' prescriptions for controlled substances.  (SD1)

RELATING TO HEALTH.

Authorizes advanced practice registered nurses, in addition to physicians, to practice medical-aid-in-dying in accordance with their scope of practice and prescribing authority.  Authorizes licensed psychiatric mental health nurse practitioners, clinical nurse specialists, and marriage and family therapists, in addition to psychiatrists, psychologists, and clinical social workers, to provide counseling to a qualified patient.  Strengthens nondisclosure protections.  Reduces the mandatory waiting period between oral requests from twenty days to fifteen days.  Waives the mandatory waiting period for those terminally ill individuals not expected to survive the mandatory waiting period.  Effective 1/1/2050.  (SD1)

RELATING TO GENETIC INFORMATION PRIVACY.

Requires direct-to-consumer genetic testing companies to adhere to certain requirements pertaining to its collection, use, and disclosure of genetic data.  Provides that any violation of the Act is deemed to be an unfair or deceptive trade practice in violation of section 480-2, Hawaii Revised Statutes.  (SD1)

RELATING TO NURSES.

Allows for temporary permits to be issued to registered nurses and licensed practical nurses from a territory or foreign country that are seeking a state license by endorsement.  Effective 1/1/2050.  (SD1)

RELATING TO HOME HEALTH CARE.

Prohibits any increase in the fees charged for providing home health care services during the pendency of an emergency proclamation or state of emergency concerning a public health pandemic on the sole basis that the patient receiving the services requires that the home health care service provider be vaccinated against the underlying disease causing the emergency.

RELATING TO CORRECTIONAL FACILITIES.

Repeals the authorization for the Governor to negotiate with any person for the development or expansion of private in-state correctional facilities.  Prohibits the establishment of private correctional facilities within the State.  Allows the governor to enter into a contract with a private entity to construct correctional facilities on public or private lands for the benefit of the State if the facilities are operated by the Department of Public Safety.  Repeals the authorization of the Governor to enter into a contract with a private entity for the lease or purchase of correctional facilities the entity constructs.
