RELATING TO MOTOR CARRIERS.

Specifies that the fee for a common or contract carrier by motor vehicle that is a tour bus operator is 2.5 per cent of the tour bus operator's gross revenues or $20, whichever is greater.

RELATING TO AIR POLLUTION.

Requires DOH to, consistent with federal law, adopt cost-effective and technologically feasible regulations to prohibit engine exhaust and evaporative emissions from new small off-road engines.  Requires DOH to report to the legislature by December 31, 2023, with recommendations for funding for commercial rebates or similar incentive funding to support the transition to zero-emission small off-road equipment operations.

RELATING TO THE STATEWIDE TRAFFIC CODE.

Prohibits any person whose driver's license has been administratively revoked or who has been convicted for offenses involving operating a vehicle under the influence of an intoxicant from being eligible for a driver's license without providing proof of compliance with the ignition interlock law.  Prohibits a person from driving for two years if the person does not own or have the use of a vehicle for the installation of an ignition interlock device or is otherwise unable to drive during the revocation period.

RELATING TO ADVANCE WARNING FOR EXCAVATION.

Applies the existing advance warning requirements to excavators operating on residential properties and clarifies various excavation requirements and reporting procedures.

Transfers the enforcement of the "Made in Hawaii" trademark from the department of agriculture to the department of commerce and consumer affairs.  Renames the "Hawaii Made" program the "Made in Hawaii" program.  Appropriates funds.  (HD1)

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW.

Allows the director of labor and industrial relations to permit owner-user inspectors in the exclusive employment of owner-user inspection organizations to perform inspections on pressure retaining items.  Extends the time from ten to thirteen years for the director to reimburse the general fund from the boiler and elevator revolving fund.  Effective 12/25/2040.  (HD1)

RELATING TO WORKFORCE DEVELOPMENT BOARDS.

Amends the Hawaii Revised Statutes to change the workforce development council to the workforce development board.  Requires the board to develop written conflict of interest policies consistent with federal law.  Amends the composition and powers of the board.  Makes other conforming amendments.  Effective 12/25/2040.  (HD1)

RELATING TO THE UNEMPLOYMENT COMPENSATION TRUST FUND.

Establishes an unemployment compensation insolvency special fund to be expended solely to resolve an unemployment compensation trust fund insolvency emergency declared by the Governor.  Permits the Governor to declare an unemployment compensation trust fund insolvency emergency and to expend moneys from the special fund if the Director of Finance determines that the trust fund balance is insufficient to meet the State's obligations.  Appropriates moneys into the unemployment compensation insolvency special fund.  Effective 12/25/2040.  (HD1)

RELATING TO THE ADEQUATE RESERVE FUND.

Amends the definition of "adequate reserve fund" to exclude the benefit cost rate from June 2020 through August 2021, effective for calendar years 2023 through 2030.  Effective 12/25/2040.  (HD1)

RELATING TO THE OAHU REGIONAL HEALTH CARE SYSTEM.

Requires the transfer of the Daniel K. Akaka state veterans home to the Oahu regional health care system and then to the Department of Health as part of the Oahu regional health care system transfer pursuant to Act 212, SLH 2021.  Extends the date of the transfer of the Oahu regional health care system to the department of health by one year.  Effective 7/1/2060.  (HD1)

Requires the department of health to establish and operate a laboratory capable of testing for diseases and air and water quality issues and other high complexity testing.  Appropriates funds.  (HD1)

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Allows a landlord or the landlord's agent, when processing an application to rent residential property, to charge an application screening fee for the cost of requesting a tenant report or credit report for a potential tenant.  Requires landlords to refund any unused amount of the application screening fee and, upon request, provide a receipt for payment of the application screening fee.  Effective 7/1/2050.  (HD1)

RELATING TO CESSPOOLS.

Establishes a temporary income tax credit until 12/31/2035 for costs of cesspool upgrade, conversion, or connection.  Requires the upgrade, conversion, or connection of cesspools upon sale of real property or within 12 months of the date of sale recordation, with certain exemptions.  Appropriates funds for additional positions to monitor and enforce cesspool upgrades, conversions, and connections.  Effective 7/1/2100.  (HD1)

RELATING TO FINANCING.

Creates the environmental and economic development revolving loan fund under the administration of the Hawaii Green Infrastructure Authority.  Allows property owners to finance qualifying improvements through a non-ad valorem property assessment.  Appropriates funds.  Effective 7/1/2100.  (HD1)

RELATING TO CESSPOOLS.

Establishes a cesspool compliance pilot grant project to assist low- and moderate-income property owners, including lessees on Hawaiian home lands, with the costs of upgrading, converting, or connecting a cesspool.  Applies to cesspools identified as failing by the Department of Health.  Appropriates funds.  Effective 7/1/2100.  (HD1)

RELATING TO ZERO EMISSION TRANSPORTATION.

Establishes a zero-emission vehicle rebate program within the public utilities commission to enable low- and moderate-income families greater access to zero-emission vehicles by providing a rebate on the point-of-sale purchase price of zero-emission vehicles.  Effective 7/1/2100.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
