RELATING TO REGULATION. Prohibits as an unfair and deceptive practice the advertisement of a good or service in the absence of licenses or permits for the good or service, to the extent the licenses or permits are required by applicable state and county laws.

RELATING TO NONPROFIT ORGANIZATIONS. Clarifies the GET exemption for unrelated trade or business activities of nonprofit organizations.

RELATING TO STATE TAX ADMINISTRATION. Expands the department of taxation's authority to require electronic filings. Requires certain tax return preparers to file returns electronically. Repeals the authorization to require electronic funds transfer or electronic filing if the federal government required that person to file or pay electronically. Removes the timeliness requirement from the electronic funds transfer penalty. Removes the authority of the department of taxation to charge for certified copies of tax clearances. Clarifies tax clearances for liquor license holders. Increases the aggregate cap on late filing penalties. Adds an additional penalty category for late filing of certain informational returns where no tax is due. Clarifies the interest calculations for taxes paid pending appeal. Provides that a partnership, estate, or trust is liable for the required withholding from a nonresident taxpayer's distributive share of income. (HD1)

RELATING TO PEER-TO-PEER CAR-SHARING INSURANCE REQUIREMENTS. Establishes peer-to-peer car-sharing insurance requirements. Effective 7/1/2050. (HD1)

RELATING TO REGISTRATION OF VEHICLES. Subjects U-drive motor vehicles to the same motor vehicle registration fees as other motor vehicles. Authorizes the counties to use certain motor vehicle registration fees to mitigate and address the impacts of tourism-related traffic congestion.

RELATING TO CONCESSIONS. Provides the department of transportation with more flexibility and discretion to address substantial hardship situations that impact airport concession contracts. Effective 7/1/2050. (HD1)

RELATING TO HOUSING. Establishes the housing choice voucher landlord incentive program. Requires the Hawaii public housing authority to adopt rules without regard to chapter 91, HRS, to establish specified incentives for landlords who participate in the tenant-based assistance housing choice voucher program under section 8 of the United States Housing Act of 1937. Requires that the Hawaii public housing authority adopt rules to establish a maximum of fifteen days after receipt of an owner's or landlord's inspection request as a reasonable time within which to inspect a dwelling unit for lease under the section 8 housing choice voucher program. Appropriates funds. Effective 7/1/2050. (HD1)

RELATING TO PHYSICIAN ASSISTANTS. Expands the scope of practice for physician assistants. Requires a sampling of medical records, rather than all medical records, to be reviewed when physician assistants prescribe controlled substances. Effective 7/1/2060. (HD1)

RELATING TO THE CENTER FOR NURSING. Requires all nursing license applicants to respond to the center for nursing workforce supply survey in conjunction with license renewal; provided that failure to respond to the workforce supply survey shall not impact license renewal or result in encumbrance of the license. Increases the center for nursing fee from $40 to $60 per license biennium. Effective 7/1/2060. (HD1)

RELATING TO HEALTH. Defines "clinical laboratory director" to include certain physicians, licensed clinical laboratory scientists, and pharmacists. Amends the definition of "practice of pharmacy" to include the ordering and performing of certain Clinical Laboratory Improvement Amendments waived tests. Effective 7/1/2060. (HD1)

RELATING TO MEDICAL CARE FOR MINORS. Permits minors to consent to medical care and services related to the diagnosis, treatment, or prevention of HIV. Specifies that a minor, under certain circumstances, shall not be liable for payment associated with the diagnosis, treatment, or prevention of HIV. Authorizes physician assistants, in addition to physicians and advanced practice registered nurses, to render such medical care and services to minors. Effective 7/1/2060. (HD1)

RELATING TO HEALTH. Clarifies the group of professionals who are prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals the landlord exclusion. Requires the Department of Health to prioritize complaint allegations based on severity for inspections of state-licensed or state-certified care facilities. Effective 7/1/2060. (HD1)

RELATING TO NURSES. Allows for temporary permits to be issued to registered nurses and licensed practical nurses from a territory or foreign country that are seeking a state license by endorsement. (HD1)

RELATING TO COFFEE. Requires coffee blend labels to disclose geographic and regional origins and percent by weight of the blended coffees. Prohibits using geographic origins of coffee in labeling or advertising for roasted or instant coffee that contains less than a certain percentage of coffee by weight from that geographic origin, phased in to a minimum of fifty-one percent after 7/1/2024. Prohibits use of the term "All Hawaiian" in labeling or advertising for roasted or instant coffee not produced entirely from green coffee beans grown in Hawaii. Appropriates moneys for the pesticide subsidy program and for purchasing equipment to test coffee content or the percentage of coffee from green coffee beans grown in Hawaii. Effective July 1, 2050. RELATING TO RECYCLING. Changes the Electronic Waste and Television Recycling and Recovery Act to the Electronic Device Recycling and Recovery Act. Establishes electronic device manufacturer recycling goals and record keeping and reporting requirements for manufacturers and collectors. Requires collectors to register with the department of health. Expands the recycling and collection requirements of televisions to all electronic devices. Requires the electronic device recycling and recovery program to include, among other things, a description of the methods for the convenient collection of electronic devices. (HD1)

RELATING TO RECYCLING. Requires the department of health to implement the auditor's recommendations for the deposit beverage container program, including developing a risk-based selection process to select reports submitted by distributors and redemption centers for audit.

RELATING TO ENVIRONMENTAL PROTECTION. Bans the manufacture, sale, or distribution for sale or use of wraps and liners, plates, food boats, pizza boxes, and firefighting foams that contain perfluoroalkyl and polyfluoroalkyl substances. Effective 7/1/2100. (HD1)

RELATING TO THE ENVIRONMENT. Prohibits lodging establishments from providing personal care products in small plastic bottles within sleeping room accommodations, any space within sleeping room accommodations, or bathrooms used by the public or guests. Establishes fines and civil penalties. (HD1)

RELATING TO DISTRICT BOUNDARY AMENDMENTS. Authorizes the appropriate county land use decision-making authority to determine district boundary amendments involving land areas over fifteen acres but less than or equal to fifty acres if the county has adopted an ordinance that meets certain requirements, including the requirement that the district boundary amendment is necessary to produce housing, sixty per cent of which shall be reserved for occupants whose incomes do not exceed eighty per cent of the area median income. Prohibits parceling of such lands. 7/1/2050. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
