RELATING TO THE JUDICIARY. Appropriates moneys for residential programs that allow minor children to remain with their mothers while the mothers participate in the program, to reduce the risk of trauma and multigenerational incarceration, including community‑based furlough programs, residential drug treatment programs, therapeutic community programs, and mental health programs. Effective 7/1/2050. (SD2)

RELATING TO RISK AND NEEDS ASSESSMENT FOR FEMALE OFFENDERS. Requires the Department of Public Safety to conduct pretrial female risk and needs assessments to measure female offenders' risk of flight, reoffending, or harming the community, and to consider factors important to women when considering their risks of reoffending and their treatment needs. RELATING TO WOMEN'S COMMUNITY CORRECTIONAL CENTER. Makes an appropriation to further the practice of huikahi restorative circles at the Women's Community Correctional Center. Effective 7/1/2050. (SD1)

RELATING TO SEARCHES OF FEMALE INMATES. Requires pat downs and searches of female inmates be conducted by a female correctional facility employee unless the prisoner presents a risk of immediate harm to herself or others or risk of escape. Prohibits male correctional facility employees from entering areas where female inmates may be in a state of undress including, but not limited to, restrooms, shower areas, or medical treatment areas, unless an inmate in the area presents a risk of immediate harm to herself or others or if there is a medical emergency in the area. Requires any prohibited search, pat down, or entry by a male correctional facility employee be documented within three days of the incident, reviewed by the warden, and retained by the institution for reporting purposes. Requires the Department of Public Safety to increase its recruitment and training of female adult corrections officers to satisfy the requirements of female gender specific posts. Requires the Department of Public Safety to make every effort within the law to address the concerns of the advocates, the requirements of the Prison Rape Elimination Act, and staffing shortages of female gender specific posts, as well as the hiring and training of female adult corrections officers. Requires a report to the legislature. Effective July 1, 2050. (SD1)

RELATING TO REENTRY PLANNING CIRCLES. Appropriates moneys to fund reentry planning circles for at least 50 incarcerated women. Effective 12/31/2050. (SD2)

RELATING TO CORRECTIONS. Establishes the Women's Corrections Implementation Commission within the Department of Public Safety to provide oversight over state correctional facilities and community correctional centers that incarcerate women; receive and investigate complaints from incarcerated women; monitor the criminal justice system's progress in implementing reforms; and monitor programs and data that are important to ensuring successful outcomes for women in the correctional system. Requires annual reports to the Legislature. Appropriates moneys. Effective 7/1/2050. (SD1)

RELATING TO PUBLIC SAFETY. Mandates that there be a community-based work furlough program for all incarcerated women in the State. Appropriates moneys. Effective 7/1/2050. (SD1)

RELATING TO INCARCERATED WOMEN. Appropriates moneys for the second year of the program that trains incarcerated women to be general education development tutors for their peers, provides college correspondence courses for women in the Women's Community Correctional Center, and provides reentry and transition services for women wanting to continue their education post-incarceration. Authorizes partnerships between the Department of Education, University of Hawaii, and Department of Public Safety. Appropriates moneys. Effective 7/1/2050. (SD2)

RELATING TO OFFENDER REENTRY. Establishes and appropriates funds for a program named Project Reset to help inmates secure post-release housing, in support of reentry, rehabilitation, and employment prospects. Effective 7/1/2050. (SD1)

RELATING TO THE COMPREHENSIVE OFFENDER REENTRY SYSTEM. Requires the Offender Reentry Office of the Department of Public Safety to develop and implement a risk needs assessment tool that is specifically intended to assess the needs of female offenders. Requires a report to the Legislature.

RELATING TO NATIVE HAWAIIAN REHABILITATION PROGRAMS. Requires the Department of Public Safety to create, in collaboration with the Office of Hawaiian Affairs, a Native Hawaiian rehabilitation program for prison inmates that emphasizes Native Hawaiian values and cultural practices. Appropriates funds. Effective 7/1/2050. (SD1)

RELATING TO FURLOUGH AND DRUG TREATMENT PROGRAMS. Appropriates funds to the Judiciary to create and expand new and existing community-based furlough programs and residential drug treatment, therapeutic living, and mental health programs for judiciary-involved women. Effective 7/1/2050. (SD2)

RELATING TO PUBLIC SAFETY. Establishes a Department of Law Enforcement to consolidate and administer criminal law enforcement and investigations functions of the State. Reestablishes the Department of Public Safety as an independent Department of Corrections and Rehabilitation to administer state corrections and rehabilitation, and reentry of the inmate population. Transfers the law enforcement functions of the Department of Public Safety to the Department of Law Enforcement, and the law enforcement functions of the Department of Transportation, the non-statutorily mandated functions of the Investigations Division of the Department of the Attorney General, and the Office of Homeland Security to the Department of Law Enforcement. Appropriates funds to the Department of Law Enforcement and Department of Corrections and Rehabilitation. Effective 7/1/2050. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
