A BILL FOR AN ACT

 

 

MAKING AN EMERGENCY APPROPRIATION TO FUND A GRANT TO THE BOARD OF WATER SUPPLY FOR EMERGENCY OPERATIONS, FUTURE PLANNING, AND GROUND WATER REMEDIATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.

     SECTION 2.  The 2021 fuel leak at the United States Navy's Red Hill fuel storage facility on Oahu and subsequent groundwater contamination is an ongoing environmental and health crisis.  Despite the Navy's agreement to drain the fuel storage tanks, the immediate threat of groundwater and aquifer contamination remains.

     The purpose of this Act is to:

     (1)  Appropriate funds to the Honolulu board of water supply for emergency operations, future planning, and remediation resulting from the contamination of the southern Oahu basal aquifer; and

     (2)  Require the Honolulu board of water supply to submit reports to the legislature on the expenditure of the funds, remediation efforts, and testing quality prior to the convening of the regular sessions of 2023, 2024, and 2025.

     SECTION 3.  There is appropriated out of the leaking underground storage tank fund established pursuant to section 342L-51, Hawaii Revised Statutes, the sum of $           or so much thereof as may be necessary for fiscal year 2021-2022, as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to be used for emergency operations, future planning, and remediation resulting from the contamination of the southern Oahu basal aquifer.

     The sum appropriated shall be expended by the department of health to fund a grant to the Honolulu board of water supply for the purposes of this Act; provided that the department of health shall seek to enter into a memorandum of understanding with the United States Navy to fully reimburse the State for the cost of this appropriation.

     SECTION 4.  The Honolulu board of water supply shall submit a report on all expenditures of funds appropriated by this Act, remediation efforts taken by the Honolulu board of water supply, and testing quality to the legislature no later than twenty days prior to the convening of the regular sessions of 2023, 2024, and 2025.

     SECTION 5.  This Act shall take effect on July 1, 2060.
