A BILL FOR AN ACT

 

 

RELATING TO OPIOIDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 329E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§329E-     Opioids; standardized metrics; value-based purchasing.  (a)  By January 1, 2023, the department of health shall develop and implement standardized quality metrics to track and address health care processes and outcomes applicable to:

     (1)  The improvement of the quality of care; and

     (2)  Targeting, through value-based purchasing, improvement in outcomes,

for patients having opioid use disorders.

     (b)  The quality metrics shall adhere to all applicable regulations and standards established by the federal Substance Abuse and Mental Health Services Administration.

     (c)  By July 1, 2023, the department of health shall implement value-based purchasing based on the standardized quality metrics developed pursuant to subsection (a).  The value-based purchasing shall be applicable to all state purchases of health and human services entered into after July 1, 2023.

     (d)  The department of health shall require health service providers to collect and report to the department the following information:

     (1)  Levels of prescribed opioids, including opioids dispensed for in-patient and emergency department use;

     (2)  Inpatient and emergency department use for opioid use disorders;

     (3)  Duration of medications for opioid use disorder pharmacotherapy;

     (4)  Retention in treatment; and

     (5)  Counseling rates.

     (e)  No less than twenty days prior to the convening of each regular session, the department of health shall submit to the legislature an annual report that includes:

     (1)  A compilation of the data compiled pursuant to subsection (d); and

     (2)  An update on the implementation of value-based purchasing."

     (f)  As used in this section, "value-based purchasing" means a system that correlates payments to providers with measures of quality of care and outcomes delivered."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
