A BILL FOR AN ACT

 

 

relating to data collection.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 846, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§846-     Systems of identification; sexual orientation and gender identity information.  (a)  In addition to identifying information collected on persons pursuant to section 846-2.5, beginning January 1, 2023, the sexual orientation and gender identity of persons for whom identifying information is kept pursuant to section 846-2.5 shall be included in the systems of identification, if disclosed.

     (b)  For purposes of this section:

     "Gender identity" means an individual's sense of being male, female, transgender, or another gender, as distinct from the individual’s sex assigned at birth.

     "Sexual orientation" means how a person identifies in terms of their emotional, romantic, or sexual attractions, and includes identification as straight, heterosexual, gay, lesbian, or bisexual, among other terms."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2022.
