A BILL FOR AN ACT

 

 

relating to recreational aquaculture.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that, for an island state like Hawaii, marine aquaculture is vital for producing responsibly sourced seafood, promoting economic development, enhancing resilience, and protecting certain species and habitats.  Additionally, recreational fishing is a nature-based activity that can be enjoyed by all ages, promotes consumption of local food, and increases public awareness of important marine issues.  Creating a state-operated facility at the Nuuanu reservoir number four and combining the income-generating benefits of aquaculture with the social and recreational benefits of fishing will support the State's economy and the well-being of its residents.  Accordingly, the purpose of this Act is to:

     (1)  Require the department of land and natural resources to designate the Nuuanu reservoir number four as a state recreation area, and as provided under section 184-2, Hawaii Revised Statutes;

     (2)  Require the invasive species council to amend administrative rules involving movement of certain species to allow the stocking of smallmouth bass, channel catfish, and rainbow trout in the Nuuanu reservoir number four; and

     (3)  Appropriate funds to the department of land and natural resources to carry out the purposes of this Act.

     SECTION 2.  The department of land and natural resources shall designate the Nuuanu reservoir number four as a state recreation area, and as provided under section 184-2, Hawaii Revised Statutes.

     SECTION 3.  The Hawaii invasive species council shall amend any applicable regulations or administrative rules regarding the movement of invasive species to allow the stocking of smallmouth bass, channel catfish, and rainbow trout at the Nuuanu reservoir number four.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the design and construction of facilities at the Nuuanu reservoir number four including but not limited to a check-in station, bathrooms, cleaning station, store, and picnic sites.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for park management staffing at Nuuanu reservoir number four.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 6.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the Anuenue fisheries research center to expand hatchery operations and supply fish to the Nuuanu reservoir number four.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.


     SECTION 7.  This Act shall take effect on July 1, 2022.
