RELATING TO HONOKOHAU SMALL BOAT HARBOR.

Establishes a working group to manage the Honokohau small boat harbor with the oversight and assistance of the division of boating and ocean recreation of the department of land and natural resources.  Working group dissolves on 6/30/2026.

      Status & Testimony

RELATING TO AQUATIC RESOURCES.

Specifies that any equipment, article, instrument, aircraft, vehicle, vessel, or business record used in violation of the aquatic resources law is subject to forfeiture.  Authorizes the imposition of a criminal fine.  Clarifies that the fine structure may be assessed on a per-specimen basis.  Makes violations of the aquatic resources law a misdemeanor, rather than a petty misdemeanor.  Permits the department of land and natural resources to recommend community service that benefits the resource damaged when a person is ordered to perform community service in lieu of a fine.

RELATING TO STATE SMALL BOAT HARBOR FEES.

Amends the various fees the Department of Land and Natural Resources may charge for the usage of state small boat harbors.  Amends how those fees are applied.

RELATING TO VESSELS.

Clarifies removal of unauthorized vessels on state property or in the waters of the State.  Clarifies the definition of an "abandoned vessel".  Reduces the time limit to claim an unauthorized vessel that is impounded by the department of land and natural resources from thirty days to ten working days.  Reduces the time limit to claim an abandoned vessel that is impounded by a state or county agency from twenty days to ten working days.  Makes abandonment of a vessel on waters of the State or public property a petty misdemeanor.  Clarifies auction requirements regarding abandoned vessels.  Allows DLNR to charge an impound storage fee.

Clarifies conditions that must be met by applicants to receive funds under the Forest Stewardship Program.

RELATING TO OCEAN RECREATION COMMERCIAL PERMITS.

Authorizes the Department of Land and Natural Resources to issue new ocean recreation commercial permits by public auction.

RELATING TO THE STATE BOATING PROGRAM.

Clarifies that the Department of Land and Natural Resources (Department) may lease any existing state boating facility in part or in its entirety without the need for prior legislative approval, and amends chapter 76, Hawaii Revised Statutes, to allow a private partner under contract to assist the Department with administrative support services, such as vessel slip management, maintenance, and monitoring.

RELATING TO THE KOKE'E STATE PARK ADVISORY COUNCIL.

Repeals section 171-8.5, Hawaii Revised Statutes, establishing the Koke'e State Park Advisory Council.
