RELATING TO LAND USE. Reorganizes and integrates the land use commission within a modified office of planning, which is renamed as the office of planning and sustainable development. Reclassifies the coastal zone management program and statewide sustainability branch as divisions within the office of planning and sustainable development.

RELATING TO COUNTY ZONING ORDINANCES. Prohibits the counties from requiring, as part of a county zoning ordinance or county rule, a developer with more than one residential unit obtain the approval of any state agency unless that approval is expressly required by law.

RELATING TO LAND AND NATURAL RESOURCES. Authorizes the board of land and natural resources to adopt, amend, and repeal administrative fee schedules without regard to chapter 91, Hawaii Revised Statutes. Establishes a process for the board to adopt, amend, and repeal administrative fee schedules, including public notice and meeting requirements.

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Removes county councils as the nominating authority for members of the HCDA who serve as representatives of the Heeia, Kalaeloa, and Kakaako community development districts. Provides that the president of the senate and the speaker of the house of representatives shall each nominate representatives of each of the three community development districts.

RELATING TO DEVELOPMENT DISTRICTS. Establishes the Pulehunui community development authority as an autonomous community development authority under the Hawaii community development authority for the purposes of developing the Pulehunui community development district. Authorizes the Hawaii community development authority to obtain various forms of federal funding for construction, maintenance, and development projects in the Pulehunui community development district.

RELATING TO REAL PROPERTY TRANSACTIONS. Beginning 07/01/2022, requires sellers to disclose whether the real property lies within the sea level rise exposure area designated by the Hawaii climate change mitigation and adaptation commission or its successor.

RELATING TO A BLACK CINDER CONE QUARRY SITE SURVEY. Requires the department of land and natural resources, in collaboration with the county of Hawaii, to conduct site surveys to identify locations for black cinder cone quarries on the island of Hawaii. Requires a report to the legislature. Appropriates funds.

RELATING TO WILDLIFE. Requires all habitat conservation plans to include an agreement for plan participants to enter into and maintain an annual service contract with a stand-by and response facility available to provide emergency medical and rehabilitation services to native wildlife affected by activities undertaken within the plan area.

RELATING TO SPECIAL LICENSE PLATES FOR NATURAL RESOURCES. Authorizes the issuance of special license plates for recognition and protection of the State's natural resources.

RELATING TO CRUSTACEANS. Repeals section 188-58.5, Hawaii Revised Statutes, which prohibits the taking or killing of female spiny lobsters, Kona crabs, and Samoan crabs.

RELATING TO OCEAN STEWARDSHIP. Establishes the Ocean Stewardship Special Fund for the collection and use of moneys for the conservation, restoration, and enhancement of the State's marine resources, and authorizes the Department of Land and Natural Resources to collect non‑resident user fees for the use and enjoyment of the State's ocean resources.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY. Transfers to the natural energy laboratory of Hawaii authority operational authority over the makai research pier located at the southeast corner of Oahu. Authorizes the director of finance to issue general obligation bonds for the natural energy laboratory of Hawaii authority to repair and upgrade the makai research pier.

RELATING TO FORESTRY. Authorizes general obligation bonds for the forest stewardship program of the department of land and natural resources to increase plant stocks, invest in public outreach, and renovate the equipment and facilities of the state tree nurseries.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
