RELATING TO A WATER STORAGE AND DISTRIBUTION SYSTEM FOR CERTAIN AGRICULTURAL LAND IN WAHIAWA, OAHU. Authorizes the issuance of general obligation bonds in the sum of $3,000,000 to fund construction costs of a water storage and distribution system on agricultural lands owned by the Office of Hawaiian Affairs in Wahiawa, Oahu, surrounding the Kukaniloko Birthing Stones site.

MAKING AN APPROPRIATION FOR A CAPITAL IMPROVEMENT PROJECT AT MAUNA KEA ON THE ISLAND OF HAWAII. Authorizes the issuance of general obligation bonds and appropriates funds for a capital improvement project for the department of land and natural resources, to be expended by the university of Hawaii, to remove the Hoku Kea telescopes from the summit of Mauna Kea.

RELATING TO WATER RIGHTS. Requires any disposition of water rights by the State to comply with existing minerals and water rights requirements. Prohibits the disposition of water rights for less than a certain percentage of the cost of the least expensive alternative source of water of similar quality and purpose, except for water leases or licenses issued for instream traditional and customary native Hawaiian practices. Requires the DLNR, commission on water resource management, and DHHL to report on the application of minerals and water rights and make recommendations for improvement.

RELATING TO DISPOSITION OF WATER LICENSES BY THE BOARD OF LAND AND NATURAL RESOURCES. Clarifies the conditions and manner in which the Board of Land and Natural Resources may dispose water by license.

RELATING TO PENALTIES FOR VIOLATIONS ON CERTAIN STATE LANDS. Decriminalizes traffic infractions within natural area reserves, game management areas, wildlife sanctuaries, and public hunting areas.

RELATING TO RENTALS FOR PUBLIC LAND LEASES. Authorizes the Board of Land and Natural Resources to approve rental reductions or waivers for leases on public lands that require substantial demolition or infrastructure improvement costs in order for the lessee to utilize the premises.

RELATING TO THE TAKING OF MARINE LIFE. Clarifies that a valid commercial marine vessel license shall satisfy the commercial marine license requirement for all persons taking marine life for commercial purposes aboard a validly licensed vessel. Requires any person who provides fishing charter services to obtain a commercial marine license.

RELATING TO LAY NETS. Authorizes the Department of Land and Natural Resources to adopt rules to establish a lay net permit for the use or possession of lay nets, including reasonable permit fees and provisions for revocation, suspension, and withholding of permits for non-compliance with lay net rules.

RELATING TO ADAPTIVE NATURAL RESOURCE MANAGEMENT. Authorizes the Board of Land and Natural Resources (Board) to temporarily adopt, amend, and repeal certain natural resource rules by formal Board action at a publicly noticed meeting if the Board finds that such adoption, amendment, or repeal is necessary to implement effective and adaptive management measures in response to rapidly changing resource conditions.

RELATING TO SCHOOL IMPACT FEES. Excludes housing developed by the Department of Hawaiian Home Lands from school impact fees.

RELATING TO A NONRESIDENT RECREATIONAL MARINE FISHING LICENSE. Establishes a nonresident recreational marine fishing license requirement and fees to enable the Department of Land and Natural Resources to more effectively manage the marine fisheries resources of the State.

RELATING TO FISHING. Requires the department of land and natural resources to license non-commercial marine fishing along with freshwater fishing, engage in public outreach prior to implementing the combined non-commercial freshwater and marine fishing license, and submit reports to the legislature. Prohibits enforcement of requirement to obtain a license to catch marine life for non-commercial purposes until 6/1/2022.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be able to testify. However, all written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
