RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Clarifies the meaning of "program or activity receiving state financial assistance". Excludes cases within the scope of the Individuals with Disabilities Education Act from the jurisdiction of the Hawaii civil rights commission.

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS FUND. Amends the definition of "employee-beneficiary" to include the surviving unmarried adult child of a deceased retired member; provided that the child is incapable of self-support due to a mental or physical incapacity, which existed prior to the unmarried child's reaching the age of majority. Effective 7/1/2020. (SD1)

RELATING TO COLLECTIVE BARGAINING. Requires the representative of labor on the Hawaii Labor Relations Board (HLRB) to be a person selected by a simple majority of the exclusive representatives of the collective bargaining units. Establishes procedures for removal of the representative of labor on the HLRB during the member's term by a simple majority of the exclusive representatives of the collective bargaining units. Takes effect 7/1/2050. (SD1)

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Authorizes a court to order the forfeiture of one-half of the Employees' Retirement System (ERS) benefits of an ERS member, former member, or retirant upon conviction of the individual for a felony related to the State or county employment of the individual. Authorizes designated beneficiaries to receive the ERS benefits to which the member, former member or retirant would be entitled under this section upon the death of the member, former member, or retirant. Prohibits designated beneficiaries convicted of a felony under the same set of circumstances as the member, former member, or retirant who was subject to forfeiture of ERS benefits from receiving benefits. Effective 7/1/2050. (SD1)

RELATING TO PUBLIC HEALTH. Requires employers to provide employees access to seizure first aid information specified by the department of labor and industrial relations. Effective 7/1/2050. (SD2)

RELATING TO CRIMINAL HISTORY RECORD CHECKS. Adds the University of Hawaii to the list of agencies that are authorized to conduct criminal history record checks on current or prospective employees, whose positions or duties are related to the security of campus facilities and persons. (SD1)

RELATING TO EMPLOYMENT. Directs the Department of Human Resources Development to convene a working group of stakeholders to update and create policies and procedures relating to telework and alternative work schedules to address the caregiving responsibilities and other needs of state employees and submit a report on its proposed telework and alternative work schedule policies and procedures, including any recommendations on proposed legislation or specific budget requests, to the Legislature no later than 20 days prior to the convening of the Regular Session of 2022. Requires departments to adopt Department of Human Resources Development policies that permit state employees to telework while caregiving during the COVID-19 pandemic. Effective 7/1/2050. (SD2)

RELATING TO PUBLIC EMPLOYEES. Requires each state government branch, and authorizes each county, to establish a shared leave program for state employees. Precludes state government branches and applicable counties from prohibiting leave sharing between employees of different departments or bargaining units because of administrative infeasibility. Allows a public employee to designate beneficiaries to the employee's unpaid vacation allowance and wages through a statement that is not verified or written. Appropriates funds. Effective 7/1/2050. DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
