RELATING TO TAX RETURN PREPARERS. Requires each tax return preparer to have a valid preparer tax identification number issued by the Internal Revenue Service and to furnish the preparer's tax identification number on any return or claim for refund if required by DOTAX. Establishes penalties for failure to comply. Provides that tax return preparers shall not be liable for penalties prior to January 1, 2022.

RELATING TO INCREASING THE PAYMENT AMOUNT FOR THE OFFICE OF HAWAIIAN AFFAIRS' PRO RATA SHARE OF THE PUBLIC LAND TRUST. Requires agencies that collect receipts for any disposition of the public land trust shall each fiscal quarter transfer to the Office of Hawaiian Affairs twenty per cent of each receipt from the disposition. Returns to the Office of Hawaiian Affairs certain moneys previously claimed as public land trust overpayments to the office. Establishes a public land trust revenues negotiating committee exempted from part I of chapter 92, Hawaii Revised Statutes. (SD1)

RELATING TO CANNABIS. Legalizes the personal use, possession, and sale of cannabis in a specified quantity. Requires licensing to operate cannabis establishments. Subjects cannabis establishments to excise taxes and income taxes. (SD1)

RELATING TO PROCUREMENT. Establishes a special procurement process for the procurement of goods and services. Requires the procurement policy board to establish rules and procedures for the special procurement process by December 31, 2021. Requires the head of a purchasing agency to prepare a procurement plan and submit the plan to the Attorney General or corporation counsel. Requires the head of a purchasing agency to electronically post, for at least one year, public notice of special procurement contracts within seven days of the contract award. (SD1)

RELATING TO THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM. Establishes the clean energy and energy efficiency revolving loan fund. Repeals the building energy efficiency revolving loan fund. Authorizes moneys in the green infrastructure special fund to be used to finance the option to purchase solar systems and other clean energy equipment, including the purchase or lease of electric vehicles. Appropriates funds out of the clean energy and energy efficiency revolving loan fund. (SD1)

RELATING TO PROCUREMENT. Repeals the establishment of the Community Council on Purchase of Health and Human Services. Amends various sections of the State Procurement Code. Establishes the State Payor Committee within the Department of Health to: (1) Implement a unified framework for tracking, coordinating, and guiding the purchase of behavioral health and homelessness services; and (2) Make recommendations to all payers who use state resources to procure behavioral health and homelessness service. Requires that the contracts be reported to the State Payor Committee prior to approval, initiation, continuation, or renewal beginning 7/1/21. Requires nongovernmental entities that contract for services relating to behavioral health, substance abuse, or homelessness services to disclose any sources of funding to perform such services. Effective 7/1/2050. (SD1)

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Suspends the requirement for public employers to make annual required contributions to the Hawaii employer-union health benefits trust fund through fiscal year 2024-2025. Effective 7/1/2050. (SD1)

RELATING TO OFFICE OF YOUTH SERVICES. Permits individual vocational programs within the purview of the Office of Youth Services to engage in commercial enterprises, including the sale of goods and services, for self-sustainability purposes, for young adults only. Establishes the Office of Youth Services Revolving Fund. Takes effect 5/1/2029. (SD1)

RELATING TO TOBACCO PRODUCTS. Makes unlawful the sale of flavored tobacco products, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes the offense of unlawful shipment of tobacco products. Includes e-liquid and electronic smoking devices within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes and tobacco products. Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products. Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices. Provides for the disposition of fines paid for the unlawful shipment of tobacco products into the Hawaii Tobacco Prevention and Control Trust Fund. Effective 1/1/2050.
