RELATING TO LOBBYING.

Expands the definition of "administrative action" in lobbyist law to include granting or denying applications for business or development-related permits, licenses, or approvals.  Clarifies that lobbying laws apply to lobbying by the executive branch.  Effective 9/1/2021.

SB 661

      Status & Testimony

RELATING TO BOARD MEETINGS.

Allows boards to use interactive conference technology to remotely conduct public meetings under the Sunshine Law in conjunction with in-person meetings, even when no emergency has been declared by government authorities.  Authorizes boards to exclude the public from nonpublic locations, such as homes, where board members are physically present when remote board meetings are held by interactive conference technology.  Establishes requirements for the conduct of remote meetings.  Establishes a new notice requirement to provide the board's contact information for the submission of written testimony by electronic or postal mail.  Amends existing option to hold in-person meetings at multiple public meeting sites connected by interactive conference technology to require termination of meeting only if audio communication is lost and cannot be reestablished within an hour and the board had not provided reasonable notice of how the meeting would be continued.  Allows for additional courtesy sites open to the public for both remote and in-person meetings held by interactive conference technology.  Allows for contact tracing and social distancing during states of emergency caused by contagious diseases.

RELATING TO STATE CAPITOL FACILITIES.

Requires the department of accounting and general services to develop and implement an enhanced security plan for the state capitol and surrounding grounds.  Amends provisions regarding the internal governance of the state capitol management committee.

RELATING TO THE STATE FOUNDATION ON CULTURE AND THE ARTS.

Allows the works of art special fund to be used for performing arts, under certain conditions.  Includes posting of a recording of performing art as a form of public display.  Defines performing arts.

RELATING TO INFORMATION TECHNOLOGY STEERING COMMITTEE.

Preserves the continuity of the information technology steering committee by establishing four-year terms for its members without regard to the holdover limitations in section 26-34, Hawaii Revised Statutes.  Redefines the member composition of the committee by allowing the superintendent of education and the president of the University of Hawaii to each appoint one member.  Requires the chief information officer to present the office of enterprise services annual report to the committee prior to submitting it to the legislature before the convening of each regular session.

RELATING TO PRIVACY.

Amends the definition of "personal information" for the purpose of applying modern security breach of personal information law.  Prohibits the sale of geolocation information and internet browser information without consent.  Amends provisions relating to electronic eavesdropping law.  Prohibits certain manipulated images of individuals.

RELATING TO BOARDS AND COMMISSIONS.

Requires the governor to appoint an individual to fill a vacancy within all boards and commissions within an unspecified period of time.  Requires that holdover appointments are limited to an unspecified period of time, thereby creating a vacancy at the end of the holdover period.  Requires department heads to inform the governor of any vacancy in any board or commission.

·         Videoconference testifiers for this hearing will be limited to two minutes each.
