Makes permanent insurance requirements for transportation network companies and transportation network company drivers established pursuant to Act 236, Session Laws of Hawaii 2016.  Effective 1/1/2050.  (HD1)

RELATING TO LIQUOR.

Provides that violations of liquor tax law shall be referred to the director of taxation for investigation.  Repeals the general right of inspection without a warrant for potential violations of liquor tax law.  Repeals the discretionary power of the liquor commission to deny a license to any person the commission finds is not fit and proper to hold a license.  Requires applications for liquor licenses to be notarized.  Provides the administrator of the liquor commission discretion over whether to refer applications for investigation.  Repeals the requirement that investigative reports to the liquor commission include any and all matters that are relevant to the application or license in the judgment of the investigator.  Effective 1/1/2050.  (HD1)

Requires the state building code council to make determinations on the financial impact, including the impact on amortized utility costs, of the adoption of a code or standard on single-family and multi-family homes and include the determinations in its annual reports to the governor.  Effective 1/1/2050.  (HD1)

RELATING TO SPECIAL PURPOSE REVENUE BONDS TO ASSIST LUANA KAI A LIFE PLAN COMMUNITY.

Authorizes the issuance of special purpose revenue bonds to assist Luana Kai A Life Plan Community with the planning, design, construction, equipping, and operating of facilities for health-related services.  Effective 7/1/2060.  (HD1)

RELATING TO CANNABIS.

Authorizes the department of health to allow a licensed dispensary to purchase up to three thousand grams of medical cannabis or manufactured cannabis products from another licensed dispensary to ensure ongoing qualifying patient access.  Increases the allowable number of production centers and retail dispensing locations per dispensary license.  Places certain limits on where qualifying patients can obtain medical cannabis or manufactured cannabis products after 12/31/21.  Prohibits primary caregivers from cultivating cannabis for qualifying patients after 12/31/21.  Permits inspections of registered grow sites by department of health or law enforcement to verify compliance with cannabis plant limits for cultivation by qualifying patients.  Limits dispensary-to-dispensary sales to those located on the same island, as long as federal law prohibits the transportation of medical cannabis over a body of water.  Effective 7/1/2060.  (HD2)

RELATING TO HUMAN TRAFFICKING.

Establishes a statewide program overseen by the department of the attorney general to provide services and assistance to commercially sexually exploited children and victims of human trafficking. Requires the attorney general to submit annual reports to the legislature.  Requires the children's justice program to coordinate the investigation and case management of child human trafficking cases, including cases involving the commercial sexual exploitation of children.  Effective 7/1/2060.  (HD2)

RELATING TO PHYSICIAN WORKFORCE ASSESSMENT.

Repeals the requirement that no less than fifty per cent of the physician workforce assessment fees deposited into the John A. Burns school of medicine special fund be used for purposes identified by the Hawaii medical education council.  Repeals the monetary cap of expenditures from the John A. Burns school of medicine special fund.  Authorizes the John A. Burns school of medicine special fund to provide loan repayment to certain physicians and scholarships to qualifying medical students.  Effective 7/1/2060.  (HD2)

RELATING TO EMERGENCY MEDICAL SERVICES.

Establishes a four-year transfer of certain duties, functions, and powers relating to emergency medical services for the city and county of Honolulu from the department of health to the city and county of Honolulu.  Begins transition with the training and billing for emergency services on 7/1/2021.  Appropriates general funds to the city and county of Honolulu for emergency medical services for fiscal years 2021-2022 and 2022-2023.  Appropriates half of the moneys in the emergency medical services special fund to the general for fiscal years 2021-2022 and 2022-2023.  Phases out state funding for emergency medical services in the city and county of Honolulu by 6/30/2025.  (HD1)

RELATING TO ELECTRONIC SMOKING DEVICES.

Expands the purposes for which moneys in the tobacco enforcement special fund may be used to include all functions of the department of the attorney general.  Renames the electronic smoking device retailer registration unit the electronic smoking device retailer registration and enforcement unit.  Expands the scope of the unit to include enforcement of compliance of electronic smoking devices with the Federal Food, Drug, and Cosmetic Act.  Establishes a special fund for moneys received from enforcement actions.  Amends the fine amount for persons under twenty-one years of age who purchase or possess tobacco products or electronic smoking devices.  Appropriates funds. Effective 07/01/2060.  (HD2)

RELATING TO TAXATION.

Imposes a fifty per cent excise tax on the wholesale price of every wholesaler for each modified risk tobacco product sold, used, or possessed by a wholesaler.  Defines modified risk tobacco product.  Establishes taxation of e-liquids used in electronic smoking devices.  Requires wholesalers and dealers to be licensed.  Requires retailers of tobacco and e-liquids to obtain permits.  Effective 7/1/2060.  (HD2)

RELATING TO TOBACCO PRODUCTS.

Establishes the offense of unlawful shipment of tobacco products.  Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes and tobacco products.  Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products.  Allocates a portion of funds collected from excise taxes on tobacco products to health education and prevention programs concerning the risks and dangers of the use of electronic smoking devices for youth.  Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices.  Effective 7/1/2050.  (HD2)

Allows the department of transportation to assess impact fees for the repair or renovation of an unsafe, privately owned roadway that connects to a state highway that is used by the public that is a substantial danger to public health and safety.  Effective 7/1/2050.  (HD1)

Requires the posting of depth gauge signs, in a manner consistent with the Federal Highway Administration's Manual on Uniform Traffic Control Devices, on any portion of a public highway that lies within a special flood hazard area and is prone to flooding.  Appropriates funds.  Effective 7/1/2050.  (HD1)

Establishes a framework for the regulation of electric foot scooters by the State and counties.  Amends definitions of "moped" to exclude electric foot scooters.  Retains personal injury protection benefits for any individual sustaining injuries while using or operating an electric foot scooter.  Effective 1/1/2050.  (HD2)

Requires any express carrier company, common or contract carrier, except water carriers as defined and regulated by the Surface Transportation Board of the United States, or other person that transports liquor from outside the State for delivery in the State to prepare and file a monthly report with the liquor commission or liquor control adjudication board of each county.  Effective 7/1/2050.  (HD2)

RELATING TO PEER-TO-PEER CAR-SHARING.

Authorizes peer-to-peer car-sharing.  Establishes the peer‑to‑peer car-sharing surcharge tax on the operator of the peer-to-peer program.  Effective 7/1/2050.  (HD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
