RELATING TO THE LANDLORD-TENANT CODE. Extends the period for a notice of summary possession from five days to fifteen. Requires landlords to enter into mediation and delays when a landlord may seek possession of a dwelling unit if the tenant schedules or attempts to schedule mediation. Requires landlords to provide the notice to mediation centers that offer free mediation for residential landlord-tenant disputes. Restricts when a landlord may exercise these remedies depending on the amount of rent due. Appropriates funds for the judiciary to contract for mediation services. Repeals one year after the expiration date of the final eviction moratorium imposed pursuant to a COVID-19 state of emergency proclamation. Effective 1/1/2050. (HD1)

RELATING TO CHARTER SCHOOLS. Requires members of the charter school commission to collectively possess strong experience and expertise in various fields. Allows the authorizer's staff to provide technical support up until the completed charter application is submitted. Clarifies charter application notice requirements. RELATING TO THE DEPARTMENT OF EDUCATION. Requires the auditor to audit the department of education's school food services branch to determine how much local produce is being purchased and served to students. Effective 7/1/2050. (HD1)

RELATING TO TEACHER HOUSING. Clarifies that DOE may construct housing for teachers on a public school campus. Requires that housing units constructed or acquired on a school campus after 6/30/2021, be rented at an affordable cost to new teachers or teachers teaching in a rural or hard-to-staff location, with priority given to teachers employed full-time at the school where the housing unit is located. Effective 7/1/2050. (HD2)

RELATING TO EDUCATION. Makes an emergency appropriation for fiscal year 2020-2021 from elementary and secondary school emergency relief fund (ESSER funds) moneys received by the State from the CARES Act and CRRS Appropriations Act to offset any budget reductions that are identified or proposed by the department of education and the governor that would result in the reduction of personnel who are subject to a collective bargaining agreement pursuant to chapter 89, HRS, and who are employed at the school level, including any budget reduction that results in a layoff, furlough, or pay reduction. Requires BOE and superintendent of education to certify in writing that BOE, superintendent, and DOE agree to certain conditions, including that the funds appropriated shall be used only for salaries and wages of officers and employees who are subject to a collective bargaining agreement and are employed at the school level. Makes an appropriation for fiscal years 2021-2022 and 2022-2023 from the same source of funding and with the same conditions. Effective 7/1/2050. (HD2)

RELATING TO ON-SITE EARLY CHILDHOOD FACILITIES. Establishes an income tax credit for employers who create on‑site group child care centers. Establishes an early childhood educator stipend program to be administered by the executive office on early learning to address the shortage of qualified early childhood educators in Hawaii. RELATING TO FEDERAL FUNDS. Requires the joint legislative budget committee, under certain circumstances, to convene and make recommendations to the legislature regarding federal funds. Provides the legislature with the opportunity to convene in special session in accordance to the state constitution to act on the recommendations, otherwise authorizes the governor to expend federal funds pursuant to the governor's emergency powers. Appropriates federal funds for COVID-19 response. Requires funding of certain programs to be paid for from the county share. (HD1)

RELATING TO EMERGENCY POWERS. Clarifies that the powers granted for emergency purposes shall not be inconsistent with the state constitution. Provides parameters for the duration of suspension of laws and requires justification for the suspension. Requires approval of the legislature by concurrent resolution to extend to a date certain, or deny the extension of, a proclamation of a state of emergency timely requested by the governor beyond sixty days of its issuance, unless the legislature fails to take action, in which case the state of emergency is automatically extended for sixty days. Allows the authorization of the issuance of a separate proclamation arising from the same emergency or disaster as a previous proclamation that expired, upon request of the governor and adoption of a concurrent resolution by the legislature. Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
