RELATING TO BOTTLED WATER.

Repeals the requirement that noncarbonated bottled water be transported, stored, processed, or bottled through lines or equipment through which only water is passed.  Updates the requirement that all bottled water shall meet standards prescribed by the United States Food and Drug Administration rules regarding product quality standards for bottled water.  (SD1)

RELATING TO THE BROWNFIELDS CLEANUP REVOLVING LOAN FUND.

Enables use of moneys in the brownfields cleanup revolving fund for subgrants to eligible entities for assessment and cleanup of brownfields sites and certain site monitoring activities.  (SD2)

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII TO GUARANTEE ALL INDIVIDUALS THE RIGHT TO HAVE A CLEAN AND HEALTHY ENVIRONMENT.

Proposes a constitutional amendment which guarantees individuals the right to a clean and healthy environment, including pure water, clean air, and healthy ecosystems, and to the preservation of the natural, cultural, scenic, and healthful qualities of the environment.  Self-executing.  Effective fifty years after approval by vote of the electorate.  (SD2)

RELATING TO LITTER CONTROL.

Prohibits the intentional release of balloons inflated with a gas that is lighter than air.  (SD1)

RELATING TO WATER POLLUTION.

Beginning January 1, 2023, bans the sale, offer of sale, or distribution in the State of any sunscreen that contains avobenzone or octocrylene, or both, without a prescription issued by a licensed healthcare provider to preserve marine ecosystems.  (SD2)

RELATING TO THE ENVIRONMENT.

Requires the department of health to fill the vacant division chief staff position within the environmental management division by 10/1/2021, and consider environmental justice issues when making certain assessments and determinations.  Requires the clean water branch to perform water quality testing during brown water advisories, inform the public of health risks associated with water runoff during brown water advisories, and establish an environmental management division oversight advisory board.  Requires the legislative reference bureau to conduct a comprehensive review of the environmental management division.  Effective 7/1/2050.  (SD2)

RELATING TO DEPOSIT BEVERAGE CONTAINERS.

Exempts a beverage dealer who is in a high-density population area from operating a redemption center if the dealer is located within one mile of a certified redemption center operated independently of the dealer.  Requires the department of health to annually adjust the handling fees for the deposit beverage container program to an amount not less than the handling fee in the prior calendar year as adjusted by percentage changes in the Consumer Price Index for the Honolulu area.  Takes effect on 7/1/2024.  (SD1)

RELATING TO CARBON OFFSETS.

Establishes procedures for the department of transportation to assist and enable a person to voluntarily purchase a verified carbon offset for carbon dioxide emissions resulting from the person's air travel to or from an airport in the State.  Effective 1/1/2050.  (SD2)

RELATING TO TRANSPORTATION.

Requires lessors of rental motor vehicles to include an option for the lessee in the motor vehicle rental agreement to contribute a sum to DLNR for the preservation and protection of the environment.  Takes effect 1/1/2023.  (SD1)

Status

RELATING TO ELECTRIC VEHICLES.

Authorizes each county to adopt ordinances to enforce section 291-71, Hawaii Revised Statutes, including the establishment of penalties for failure to comply with its requirements or make reasonable efforts to maintain electric vehicle (EV) charging stations in working order.  Clarifies that certain enforcement officers may enter private property to enforce EV parking space violations.  Requires new EV charging systems installed pursuant to the EV charging system requirement to be at least Level 2 and network capable.  Changes EV charging equipped parking requirements per one hundred stalls from one stall by 2012 to five stalls by 2025 and ten stalls by 2030.  (SD2)

Status

RELATING TO RENEWABLE ENERGY.

Requires the Hawaii Natural Energy Institute to develop a strategic plan that outlines benchmarks to achieve a 100% renewable energy portfolio standard and to submit the strategic plan to the Legislature no later than 20 days prior to the convening of the Regular Session of 2023.  Requires the Hawaii Natural Energy Institute to conduct a feasibility study on the State's ability to achieve its renewable energy goals by 2045 and to submit its findings and recommendations to the Legislature no later than 20 days prior to the convening of the Regular Session of 2023.  Effective 7/1/2050.  (SD2)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
