RELATING TO DECEPTIVE TRADE PRACTICES.

Establishes that charging shipping and delivery charges that exceed the actual cost to ship or deliver a commodity to a consumer in Hawaii shall constitute an unfair and deceptive practice.  (SD1)

RELATING TO PUBLICITY RIGHTS.

Clarifies the rights of publicity includes the rights of individuals who died prior to the enactment of the Hawaii Publicity Rights Act.  Applies retroactive to July 15, 2009.  (SD1)

Status

RELATING TO HAWAII MONEY TRANSMITTER ACT.

Amends the Money Transmitters Act.  Changes the chapter and short title to Monetary Transmitters Modernization Act.  Incorporates definitions of key terms provided in the Model Money Services Business Law published by the Conference of State Bank Supervisors.  Adds supporting documentation to be submitted by a license applicant.  Extends the period of a license applicant's litigation and criminal conviction history review from five-years to ten-years from the date of the application.  Requires a license applicant to submit information concerning any bankruptcy or receivership proceedings.  Clarifies the authority of the commissioner of financial institutions relating to examinations and investigations of licensees and participation in nationwide protocols for licensing cooperation.  (SD1)

RELATING TO ALCOHOL.

Expands the definition of "beer" to specify an alcohol by volume of no less than 0.5 per cent and to include alcoholic seltzer beverages.  Effective January 1, 2022.  (SD1)

RELATING TO GENERAL EXCISE TAX.

Authorizes the director of taxation to exempt a taxpayer whose annual general excise tax liability does not exceed $100 from monthly, quarterly, or semiannual general excise tax filing requirements; provided that the taxpayer files an annual return.  Applies to taxable years beginning after 12/31/2021.  (SD1)

RELATING TO AEROSPACE.

Establishes the Office of Aerospace Development in the Hawaii Technology Development Corporation instead of the Department of Business, Economic Development, and Tourism.  Repeals references to the Pacific International Space Center for Exploration Systems.  Transfers the rights, powers, functions, and duties of the Pacific International Space Center for Exploration Systems to the Office of Aerospace Development.  Allows the Aerospace Advisory Committee to select the Director of the Office of Aerospace Development.  Reduces the number of members on the Aerospace Advisory Committee.  (SD2)

RELATING TO TITLE 14, HAWAII REVISED STATUTES.

Amends title 14, Hawaii Revised Statutes, to make nonsubstantive changes for clarity and to delete obsolete provisions. (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
