      Status & Testimony

RELATING TO BUSINESS REGISTRATION.

Prohibits the Director of the Department of Commerce and Consumer Affairs from issuing certificates of good standing unless the entity has submitted a certificate of vendor compliance with its annual report certifies compliance with the Internal Revenue Service, Department of Labor and Industrial Relations, Department of Commerce and Consumer Affairs, and the Department of Taxation.  Requires entities to submit certificates of vendor compliance as part of their annual reporting requirements.

SB 562

      Status & Testimony

RELATING TO DECEPTIVE TRADE PRACTICES.

Clarifies that any person that offers free or reduced rate shipping to a consumer in another state but who refuses to honor that shipping offer to a consumer in Hawaii has engaged in an act that is unfair and deceptive under certain conditions.  Extends remedies.

RELATING TO EQUITABLE GENDER REPRESENTATION ON CORPORATE BOARDS.

Requires publicly held domestic corporations to include non‑male and non‑female individuals among the directors of their corporate board.  Establishes reporting requirements for the Department of Commerce and Consumer Affairs and penalties.

RELATING TO CORPORATIONS.

Requires domestic and foreign corporations to provide their shareholders with reports of independent expenditures and political contributions.

SB 320

      Status & Testimony

RELATING TO TAX RETURN PREPARERS.

Requires each tax return preparer to have a valid preparer tax identification number issued by the Internal Revenue Service and to furnish the preparer's tax identification number on any return or claim for refund if required by DOTAX.  Establishes penalties for failure to comply.  Provides that tax return preparers shall not be liable for penalties prior to January 1, 2022.

RELATING TO ALCOHOL.

Expands the definition of "beer" to specify an alcohol by volume of no less than 0.5 percent and to include alcoholic seltzer beverages.

SB 223

      Status & Testimony

RELATING TO CONTRACTING.

Requires contractors and subcontractors to submit tax clearances as a condition of:  (1) obtaining building permits for private developments exceeding a certain value; (2) assigning a contract for private developments exceeding a certain value; and (3) obtaining final inspection of private developments exceeding a certain value.  Authorizes the department of taxation to require that tax clearance applications be submitted electronically.  Establishes penalties.  Appropriates funds for grants-in-aid to the counties.

SB 601

      Status & Testimony

RELATING TO ROOFING CONTRACTORS.

Prohibits roofing contractors from offering to pay, in any monetary form, an insured's insurance deductible as an incentive to encourage the insured to hire the contractor.  Allows insureds to rescind contracts with roofing contractors within five business days of receiving notification from an insurer that all or any part of a claim or contract is not a covered loss under the insured's insurance policy.  Allows the Contractors License Board to revoke, suspend, or refuse to renew a contractor's license if the contractor performs as a public adjuster without a public adjuster license.

SB 576

      Status & Testimony

RELATING TO USED MOTOR VEHICLE PARTS.

Requires licensed used motor vehicle part dealers to obtain a written statement by a seller of a catalytic converter that the seller has the lawful right to sell and dispose of the catalytic converter.  Requires a seller of a catalytic converter to present a receipt or notarized declaration regarding the catalytic converter.  Prohibits a licensed used motor vehicle part dealer from purchasing a catalytic converter with no receipt or notarized declaration and to report the attempted sale to the police.  Establishes the offense of theft of catalytic converter as a class C felony.
